El presente trabajo de investigación, que lleva por título “OBLIGACIONES
TRIBUTARIAS Y LAS RENTAS DE LOS PROPIETARIOS DEL CENTRO COMERCIAL
SUCESION SOTOMAYOR DEL DISTRITO DE CUSCO PERIODO 2018”.
Los propietarios del centro comercial Sucesión Sotomayor, obtienen ingresos que
provienen de otras actividades económicas, que no están ligadas a la renta de primera categoría
y por las cuales cumplirían sus obligaciones tributarias; pero estarían evadiendo su obligación
frente a la renta de primera categoría, lo cual les generaría un ingreso adicional que no fue
declarado.
Tiene por objetivo determinar cuál es la situación de las obligaciones Tributarias y las
rentas de los propietarios del Centro Comercial Sucesión Sotomayor en el Distrito de Cusco,
periodo 2018.
No poseemos hipótesis de investigación ya que por naturaleza de la investigación y al
ser de alcance descriptivo según Hernández; Sampieri & Bapstita, no es necesario formular
Hipótesis.
La Obligación tributaria es el vínculo entre el acreedor y el deudor tributario,
establecido por ley, que tiene por objeto el cumplimiento de la prestación tributaria. Dentro de
esta tenemos dos tipos de obligaciones; obligaciones formales y sustanciales. Así mismo la
identificación de las Rentas que generan es primordial, para reconocer cuáles son sus
obligaciones frente a la Administración Tributaria.
El presente estudio tiene el siguiente alcance: Descriptivo, con Diseño no Experimental
y Enfoque Cuantitativo. En la información obtenida de la muestra 1 con respecto a las obligaciones
sustanciales (Tabla 39 y Tabla 40), los arrendadores estarían cumpliendo parcialmente con su
obligación sustancial. Pero de acuerdo a la información obtenida con respecto a las obligaciones
formales que se llegó a confortar de ambas muestras, existía una discrepancia puesto que los
arrendadores no estarían cumpliendo con sus obligaciones formales, por en tampoco cumplirían
su obligación sustancial.
El 53% de los propietarios cumplen con sus obligaciones formales, mientras que
contrastando con la información de los arrendatarios pudimos observar que los propietarios no
cumplen como debe de ser sus obligaciones formales; así mismo las obligaciones sustanciales
de acuerdo a las tablas 39 y 40 especifica que, los propietarios cumplen parcialmente con sus
obligaciones sustanciales, pero eso generaría una discrepancia entre que no cumplen su
obligación formal, pero cumplirían parcialmente su obligación sustancial, lo cual no tendría una
relación coherente. The owners of the Sotomayor Succession shopping center obtain income that comes
from other economic activities, which are not linked to first-class income and for which they
would fulfill their tax obligations; but they would be evading their obligation against first-class
income, which would generate additional income that was not declared.
Its objective is to determine the status of the Tax obligations and the income of the
owners of the Sotomayor Succession Shopping Center in the District of Cusco, 2018 period.
We do not have research hypotheses because, due to the nature of the research and
being descriptive in scope according to Hernández; Sampieri & Bapstita, it is not necessary to
formulate Hypothesis.
The Tax Obligation is the link between the creditor and the tax debtor, established by
law, which aims to fulfill the tax benefit. Within this we have two types of obligations; formal
and substantial obligations. Likewise, the identification of the Income they generate is essential,
in order to recognize their obligations vis-à-vis the Tax Administration.
The present study has the following scope: Descriptive, with Non-Experimental Design
and Quantitative Approach.
In the information obtained from sample 1 with respect to the substantial obligations
(Table 39 and Table 40), the lessors would be partially fulfilling their substantial obligation. But
according to the information obtained regarding the formal obligations that were comforted in both samples, there was a discrepancy since the lessors would not be fulfilling their formal
obligations, nor would they fulfill their substantial obligation.
53% of the owners fulfill their formal obligations, while contrasting with the
information of the tenants we could observe that the owners do not fulfill as their formal
obligations should be; likewise, the substantial obligations according to tables 39 and 40 specify
that, the owners partially comply with their substantial obligations, but that would generate a
discrepancy between those who do not fulfill their formal obligation, but partially fulfill their
substantial obligation, which would not have a consistent relationship.
