Principio de reciprocidad positiva y negativa como una medida que favorece la correcta interpretación y aplicación del proceso de exequatur en el Derecho Internacional Privado Peruano (Propuesta Legislativa).

Abstract

Esta investigación responde a la necesidad, principalmente, el de determinar si la aplicación del principio de reciprocidad positiva y negativa constituye una medida que favorece una correcta interpretación y aplicación del proceso de Exequátur en el derecho internacional privado peruano y finalmente con los objetivos específicos se pretende conocer cuáles son las características, principios, funciones e importancia del Exequátur en la doctrina del derecho internacional privado, precisar cuál ha sido el tratamiento del derecho internacional privado para la incorporación del Exequátur en el Perú, precisar cuál ha sido el tratamiento del proceso de exequátur, en la Ley 28677 y conocer qué es el principio de reciprocidad en el derecho internacional, así como determinar de qué manera el principio de reciprocidad puede mejorar la correcta interpretación y aplicación del proceso de exequátur. En ese sentido, la investigación está estructurada en tres capítulos: El capítulo primero es referente al problema de investigación, el mismo que aborda el planteamiento y formulación del problema, objetivos, justificación y delimitación del estudio. El capítulo segundo trata sobre el marco teórico, antecedentes de investigación, bases teóricas, sistema de hipótesis y variables de estudio. El capítulo tercero es referente al resultado y discusión de la investigación, así como la propuesta legislativa. Por último se consigna las conclusiones y recomendaciones del estudio, así como las referencias bibliográficas consultadas.

This research responds to the need to determine whether the application of the principle of positive and negative reciprocity constitutes a measure that favors a correct interpretation and application of the process of exequatur in the Peruvian private international law and finally the specific objectives is to know which Characteristics, Principles, Functions and Importance of exequatur in the doctrine of private international law, specify what has been the treatment of private international law for the incorporation of exequatur in Peru and know which is the principle of reciprocity in international law, determine how the principle of reciprocity can improve the correct interpretation and application of the exequatur process. In that sense, research structured in three chapters:

Chapter One is Referring to the research, the same approach and address the problem formulation, Objectives and justification and delimitation of study. Second Chapter the theoretical framework, antescedentes Research, theoretical bases, hypotheses and study variables. In the third chapter is the result and dissemination of research and the legislative proposal. Finally the Conclusions and Recommendations of the study and consulted references.
