Modelo de organización para la integración de los Servicios Turísticos Culturales del Cusco-2017

Abstract

En los Servicios Integrados Turísticos Culturales del Cusco existen contradicciones en cuanto a la normatividad del régimen legal y organización administrativa, originada por la falta de personería jurídica y la denominación de “Comité”. La presente investigación científica tiene como propósito proponer un modelo de organización administrativa de los servicios integrados turísticos culturales del Cusco acorde a ley del Boleto Turístico. La historia de la Integración de los Servicios Integrados Turísticos Culturales del Cusco durante los años de vida institucional ha tenido que afrontar problemas que desestabilizaron la organización administrativa. El enfoque de la investigación es cualitativo, el diseño es la teoría fundamentada con carácter descriptivo y propositivo; mediante el estudio de categorías del régimen legal y organización administrativa en la unidad de análisis del denominado “Comité de Servicios Integrales Turísticos Culturales del Cusco” utilizando el análisis documental, encuestas no probabilísticas a profesionales relacionados con el turismo y encuesta estructurada de tipo abierto dirigida a funcionarios y exdirectores. El cambio de régimen de derecho público a derecho privado se da por decreto supremo que reglamenta la Ley del Boleto Turístico, produciendo un cambio de régimen de organización administrativa a partir del año 2011 cuya reestructuración origino órganos administrativos innecesarios a la propia función de recaudación y distribución de los ingresos por la venta de los boletos turísticos Cusco. Un nuevo modelo de organización acorde a la Ley del Boleto Turístico con fundamentación del Derecho Público como ente desconcentrado de la Municipalidad del Cusco, mediante una unidad ejecutiva viabilizará la estabilización de la organización administrativa y legal de la integración de los servicios turísticos culturales del Cusco.

In the Integrated Cultural Tourist Services of Cusco there are contradictions regarding the regulations of the legal regime and administrative organization, caused by the lack of legal status and the name of “Committee“. The purpose of this scientific research is to propose a model of administrative organization of the integrated cultural tourism services of Cusco according to the Tourist Ticket law. The research approach is qualitative, the design is action research, analytical, descriptive and purposeful; through the study of categories of the legal regime and administrative organization in the unit of analysis of the “Committee of Cultural Comprehensive Tourist Services of Cusco“ using documentary analysis, unstructured interviews with officials and surveys of professionals related to tourism. The change from public to private law regime is given by supreme decree that regulates the Tourist Ticket Law, producing a change of administrative organization regime from the year 2011 whose restructuring originated unnecessary administrative organs to the collection and distribution function itself of the income from the sale of tourist tickets Cusco. A new model of organization according to the Tourist Ticket Law based on Public Law as a decentralized entity of the Municipality of Cusco, through an executive unit will enable the stabilization of the administrative and legal organization of the integration of cultural tourism services of Cusco.
