dc.description.abstractEl principio de Seguridad jurídica es uno de los principios más importantes en el marco del derecho , ello a razón de que este otorga a la población certeza y confianza en las mismas, bajo esta premisa, el presente trabajo de investigación tiene como fin determinar si existe una afectación de dicho axioma frente a la inexistencia de una regulación específica en el Comercio electrónico en el Perú, ya que, en caso de que un consumidor realice una compra para su uso y disfrute personal o familiar en las plataformas virtuales este no se encuentra con la certeza de que si existiera alguna infracción que vulnere sus derechos como “consumidor” este se vea totalmente protegido por el ordenamiento jurídico peruano , pues , consideramos que el Código de Protección y defensa del consumidor Ley N° 29571 , brinda una protección general y no engloba de manera específica lo concerniente al comercio electrónico como tal . Es por esta razón que el presente trabajo de investigación tiene como objetivo general establecer como se ve afectado el principio de Seguridad Jurídica en el consumidor frente a la inexistencia de una regulación específica para el Comercio Electrónico en el Perú.; las dificultades que enfrentan los consumidores que utilizan este tipo de comercio, son en primer lugar la dificultad de verificar quienes son los sujetos con los que se inició la relación de consumo comercial, en segundo lugar cual es domicilio especifico de la empresa proveedora o de sus representantes, y por último el derecho del consumidor a poder acogerse a la figura del arrepentimiento la cual si está regulada en otros países creando certeza al consumidor y protegiendo el principio de seguridad jurídica debido a que este derecho específicamente elaborado para las transacciones electrónicas. Se puede concluir que el objetivo general se ha visto alcanzado , consecuentemente, la hipótesis general ha sido debidamente probada , comprobándose que el principio de seguridad jurídica en el consumidor se ve afectado significativamente por la inexistente regulación específica del comercio electrónico en el Perú.es_PE
dc.description.abstractABSTRACT The principle of Legal Security is one of the most important principles in the framework of the law, this is because it gives the population security and confidence in them, under this premise, this research work is intended to determine if there is an affectation of said law. axiom in the absence of a specific regulation in electronic commerce in Peru, since, in the case that a consumer makes a purchase for personal and family use and enjoys virtual platforms, it does not comply with the certainty that if there is an infraction that violates your rights as a “consumer“, this is fully protected by the Peruvian legal system, therefore, we consider that the Law of the Consumer Protection and Defense Code No. 29571, provides general protection and does not specifically cover electronic commerce as such. It is for this reason that the present research work has as a general objective to establish how the principle of Legal Security in the consumer is affected in the absence of a specific regulation for Electronic Commerce in Peru; The difficulties faced by consumers who use this type of trade are, in the first place, the difficulty of verifying who are the subjects with whom the relationship of commercial consumption began, secondly, what is the specific domicile of the supplier company or its representatives, and finally, the right of the consumer to be able to take advantage of the figure of repentance that, if regulated in other countries, creates security for the consumer and protects the principle of legal certainty because this right was developed specifically for electronic transactions. It can be concluded that the general objective has been achieved, consequently, the general hypothesis has been duly tested, verifying that the principle of legal certainty in the consumer is significantly affected by the non-specific regulation of electronic commerce in Peru.en_US
