dc.description.abstract | La filiación es un vínculo natural, biológico existente entre el hijo y los padres que lo han procreado, vínculo que nace naturalmente con la procreación del hijo, pero que legalmente deriva con el reconocimiento delos padres a sus hijos o por último en caso de ausencia de reconocimiento, por presunción de la misma ley y hasta por mandato judicial.
La esencia del proceso de filiación extramatrimonial es que a través de la prueba genética del ADN se determine que la persona demandada resulte ser el padre biológico del menor o
del demandante según sea el caso.
Con el Código Civil de 1936 los hijos nacidos de padres no casados eran denominados hijos ilegítimos, término éste que no sólo implicaba desigualdad de trato legal con los hijos de padres casados, sino también era una calificación peyorativa, y que trasuntaba una situación contra la ley, situaciones éstas odiosas e injustas, sobre todo considerando que el hijo no tenía culpa alguna de tal hecho; ahora bien, el código de 1984; sin entrar a calificar, denomina hijos extra matrimoniales a aquellos concebidos y nacidos fuera del matrimonio tal como se desprende del Artículo N° 386 del Código Civil Peruano; por otro lado, toda la normatividad referida a los hijos está impregnada de la igualdad de los mismos, sean estos matrimoniales o extra matrimoniales, como lo manda la Constitución Política de la República del Perú en su artículo 2 inciso 2 y especialmente el artículo 6, sin embargo esta igualdad no significa dejar de lado la posición de estos hijos en relación a sus padres, unos, provenientes de relaciones matrimoniales y otros de padres no casados, tal como ya ha sido señalado, y además, porque las instituciones del Derecho de Familia, tales como la patria potestad, autorización para matrimonio, tutela, entre otros, están regulados en función a la posición de los hijos respecto de sus padres.
Tal es el caso de la presente investigación intitulada: “La filiación extramatrimonial post mortem en la Ley N°28457”, la misma que responde al objetivo principal de establecer las razones que justifican suficientemente la incorporación de la filiación extramatrimonial post mortem en la Ley N°28457. Finalmente con los objetivos específicos se pretendió determinar los beneficios de la incorporación del instituto jurídico de la filiación extramatrimonial post mortem en la en mención, entre otros aspectos los cuales fueron desarrollados en la tesis.
En ese sentido, la investigación está estructurada en cuatro capítulos: el capítulo primero es referente al problema de investigación, el mismo que aborda el planteamiento y formulación del problema, objetivos, justificación y delimitación del estudio. El capítulo segundo trata sobre el marco teórico, antecedentes de investigación, bases teóricas, sistema
de hipótesis y variables de estudio. El capítulo tercero es referente a la metodología, consisten en el nivel y tipo de investigación, población y muestra, técnicas e instrumentos de recolección de datos y técnicas para el análisis de resultados. El capítulo cuarto trata sobre la presentación y análisis de resultados de la investigación, donde se obtiene los resultados contrastando con los objetivos planteados. Por último se consigna las conclusiones y recomendaciones del estudio, así como las referencias bibliográficas consultadas. | es_PE |
dc.description.abstract | The affiliation is an existing natural biological bond between the child and parents have
procreated, a bond that comes naturally to procreation of the child, but legally drift
recognition models parents to their children or finally in the absence of recognition on the
assumption that law and even by court order. The essence of the process is that extramarital
affiliation through genetic DNA testing determined that the defendant happens to be the
biological father of the child or the applicant appropriate.
With the civil code of 1936 children born to unmarried parents they were called illegitimate
children, a term that not only implied unequal legal treatment to children of married
parents, but was also a pejorative qualifications, and exuded a situation against the Law,
odious and unfair these situations, especially considering that the son had no fault of that
fact; however, the Code of 1984, without assessing, called extramarital those children
conceived and born out of wedlock as is clear from Article No. 386 of the Peruvian Civil
Code; on the other hand, all the regulations relating to children is imbued with the same
equality, whether marital or extramarital, as mandated by the Constitution of the Republic
of Peru in Article 2, paragraph 2, and especially Article 6 but this equality does not mean
neglecting the position of these children in relation to their parents about, from marital
relations and other unmarried parents, as has already been pointed out, and also because the
institutions of family law such as custody, permission to marriage, custody, among others,
are regulated according to the position of children from their parents.
Such is the case of the present research entitled: “The post mortem extramarital affiliation
in Law N° 28457“, the same as for the primary purpose of establishing the reasons
sufficiently justify the incorporation of extramarital paternity post mortem in Law N°
28457. Finally with specific objectives aimed to determine the benefits of incorporating the
legal institution of affiliation in wedlock post mortem in question, among other things
which were developed in the thesis.
In that sense, research is divided into four chapters: the first chapter is a reference to the
research, which addresses the same approach and formulation of the problem, objectives,
justification and delimitation of the study. The second chapter discusses the theoretical
framework, research background, theoretical bases, assumptions and system variables
studied. The third chapter is concerning the methodology, consisting of the level and type
of research, population and sample, techniques and data collection instruments and
techniques for the analysis of results. The fourth chapter deals with the presentation and
analysis of results of research, where results contrast with the objectives is obtained. Finally
it entered the conclusions and recommendations of the study and consulted references. | en_US |
