Los tribunales nacionales han aplicado la norma de la inmunidad jurisdiccional estatal
desde inicios del Siglo XIX, aplicando progresivamente una posición restringida de la
misma. No obstante, su desarrollo fue particular y fragmentado de tribunal a tribunal, razón
que impulsó su codificación por parte de la Comisión de Derecho Internacional en el
Proyecto de artículos que ahora forma parte de la Convención de Naciones Unidas sobre
inmunidades jurisdiccionales de los Estados y sus bienes. Si bien esta norma toma una
posición restringida de la inmunidad en lo referido a contratos de trabajo, el apartado c) del
segundo párrafo del artículo 11 ha dejado intacta la inmunidad de jurisidicon para el Estado
extranjero que contrata personal local en el Estado del foro. Bajo los términos de esta
Convención, los empleados de misiones diplomáticas acreditadas en los Estados de donde
son nacionales, no tienen acceso a los tribunales laborales y fácticamente a ninguna otra
instancia para la determinación de sus derechos. De esta forma, al exponer a la inmunidad
al test de proporcionalidad, se concluye en que existe una vulneración al derecho de acceso
a un recurso efectivo de los empleados despedidos por aplicación de la inmunidad en
procesos que tengan por pretensión la reposición laboral.
