Cumplimiento de las obligaciones laborales y tributarias en las pequeñas empresas de servicios de cafetería y repostería acogidas a REMYPE, Cusco – 2016.

Abstract

El presente trabajo de investigación fue desarrollado con el objetivo de determinar cómo ha sido el cumplimiento de las obligaciones laborales y tributarias de las pequeñas empresas de cafetería y repostería acogidas al REMYPE durante el periodo 2016 y determinar cuáles son estas. La tesis se realizó con el estudio de la ley Nº 28015 y Ley Nº 30056, que regula el régimen laboral especial (RLE) para las micro y pequeñas empresas acogidas al registro nacional de la micro y pequeña empresa (REMYPE), los regímenes tributarios para estas, revistas y artículos Web, e información de la base de datos de la Sunat, con la finalidad de conocer a fondo sobre la investigación. La tesis es de enfoque cualitativo, descriptivo contextual, la unidad de estudio fue de un grupo económico constituido por cuatro empresas acogidas al Registro Nacional de la Micro y Pequeña empresa (REMYPE), tomando la calidad de pequeña empresa, regulada por las leyes antes mencionadas y ubicadas en distintos lugares de nuestra ciudad del Cusco. Con nuestra investigación se determinó la vinculación de estas empresas pertenecientes a un mismo grupo empresarial, no correspondiéndole la reducción del pago de sus obligaciones laborales establecidas por el Régimen Laboral Especial (RLE), el cual les genera una reducción significativa de su costo de personal, calificadas para su exclusión del REMYPE, recurriendo en prácticas elusivas para la reducción de sus impuestos y no exceder los límites establecidos de ingresos que les da la calidad de micro pequeña empresa MYPE.

The present research work was developed with the objective of determining how compliance with the labor and tax obligations of the small cafeteria and pastry companies under REMYPE has been during the 2016 period and to determine what these are. The thesis is qualitative, descriptive, contextual approach, the sample taken was four companies covered by the National Registry of Micro and Small Enterprises (REMYPE), taking the quality of small business, regulated by the aforementioned laws and located in different places of our city of Cusco. With our research, the linkage of these companies belonging to the same business group was determined, not corresponding to the reduction of the payment of their labor obligations established by the Special Labor Regime (RLE), which generates a significant reduction in their personnel cost, qualified for their exclusion from REMYPE, resorting to avoidance practices for the reduction of their taxes and not exceeding the established income limits that the quality of small microenterprise and microenterprise (MYPE) gives them.
