dc.description.abstract | El presente trabajo de investigación parte de un tema objetivo, el mismo
que posee connotaciones jurídicas y sociales, se refiere pues a la “Prohibición de
conclusión del proceso de alimentos en favor de niños y adolescentes por
inconcurrencia de las partes a la Audiencia única”. Resulta evidente que nuestra
legislación actual, respecto a los procesos de alimentos que conocen los Juzgados
de Paz Letrado, dentro del marco del Código del Niño y Adolescente y con la
aplicación supletoria del Código Procesal Civil, específicamente el artículo 203°
que señala en su última parte, que se dispondrá la conclusión del proceso si no
concurren ambas partes a la audiencia; sin embargo, esta disposición conlleva a la
vulneración del derecho alimentario de los niños y adolescentes, pues de ser
concluido el proceso, sea o no responsabilidad de la madre del menor su
inasistencia, por las razones que sea, tendrá que recurrir nuevamente a la instancia
judicial a interponer la demanda de alimentos o interponer un recurso impugnatorio
o recurrir al ámbito constitucional – lo que llevará tiempo – y es el transcurso del
tiempo ocasionada por la conclusión del proceso, la que incluso afecta el Principio
del Interés Superior del Niño.
En consecuencia, la situación expuesta merece su corrección normativa, pues
el juzgador se ve obligado a aplicar la Ley, sobreponiéndola al derecho
fundamental alimentario, que debería constituir en la práctica una garantía
inmediata sin limitaciones, que es lo que pretendo sustentar en la presente tesis
mediante la propuesta legislativa, exponiendo las razones jurídicas que darán
soporte objetivo a mi investigación.
Las razones jurídicas que desarrollaré son precisamente aspectos doctrinarios y
jurisprudenciales, que finalmente servirán de exposición de motivos del proyecto
de ley, que espero en su momento de considerar el jurado, recomiende sea elevado
a través de las autoridades universitarias al representante del Parlamento de nuestra
región.
Es así que el primer Capítulo de la presente tesis versa sobre los aspectos
metodológicos con los que cuenta la misma, es decir el problema, la justificación y
la hipótesis, entre otros. En el Capítulo Segundo se desarrolla el marco teórico
normativo y conceptual de la investigación, para cuyo efecto se describe el
tratamiento jurídico del proceso de alimentos para niños y adolescentes en el Perú,
el tratamiento jurídico del Principio del Interés Superior del Niño y como se
encuentra regulada la conclusión del proceso en la legislación procesal en el Perú;
en el Capítulo Tercero se identificará cuál es el sustento jurídico a partir de la
jurisprudencia que justifica la modificación de la parte in fine del artículo 203° del
Código Procesal Civil, para establecer la prohibición de conclusión del proceso de
alimentos en favor de niños y adolescentes por inconcurrencia de las partes a la
audiencia única. Finalmente se considerará las Conclusiones y Recomendaciones y

dc.description.abstract | The present research work is based on an objective theme, which has legal and social
connotations, and refers to the “Prohibition of the conclusion of the process of food for
children and adolescents due to the parties' failure to attend the sole hearing“. It is evident
that our current legislation, regarding the food processes known to the Magistrates Courts,
within the framework of the Child and Adolescent Code and with the supplementary
application of the Civil Procedure Code, specifically Article 203, which states in its last part,
that the conclusion of the process will be arranged if both parties do not attend the hearing;
However, this provision leads to the violation of the right to food of children and adolescents,
because if the process is concluded, whether or not the minor's mother is responsible for his
absence, for whatever reasons, he will have to resort again to the judicial to interpose the
demand of foods or to interpose a resource impugnatorio or to resort to the constitutional
scope - which takes time - and is the passage of time caused by the conclusion of the process,
which even affects the Principle of the best interest of the child.
Consequently, the exposed situation deserves its normative correction, because the judge
is forced to apply the Law, superimposing it on the fundamental right to food, which should
constitute in practice an immediate guarantee without limitations, which is what I intend to
support in this thesis through the legislative proposal, setting out the legal reasons that will
give objective support to my research.
The legal reasons I will develop are precisely doctrinal and jurisprudential aspects, which
will finally serve as an explanatory statement of the bill, which I hope at the time of considering the jury, recommend it be raised through the university authorities to the
representative of the Parliament of our region.
Thus, the first chapter of this thesis deals with the methodological aspects that account for
it, ie the problem, the justification and the hypothesis, among others. In Chapter Two the
theoretical and conceptual framework of the research is developed, for which purpose the
legal treatment of the food process for children and adolescents in Peru is described, the legal
treatment of the Principle of the Higher Interest of the Child and how it is found. regulated
the conclusion of the process in the procedural legislation in Peru; in the Third Chapter will
identify what is the legal support from the jurisprudence that justifies the modification of the
