dc.description.abstract | El hombre es un ser social, vive en una sociedad con reglas de conducta que regulan su
comportamiento dentro de ella, todos los integrantes de la sociedad tienen los mismos
derechos, el derecho de acceso a la administración de justicia está reconocida en la
Constitución política del Perú y en los tratados internacionales de las que el Estado
peruano es parte, el territorio peruano está dividido en regiones provincias, distritos,
centros poblados, comunidades, anexos, sectores, barrios, etc. La provincia de Canchis
es una de las trece provincias del departamento de Cusco, cuenta con 8 distritos, 110
comunidades, y un número no determinado de Centros poblados, anexos y sectores.
Los pobladores de las comunidades alejadas de la provincia de Canchis, aún siguen
teniendo limitaciones estructurales, sociales e ideales para acceder a la administración
de justicia, ejercer su derecho de acceso a la justicia, recibir un debido proceso y
finalmente recibir una tutela jurisdiccional efectiva que solucione y repare sus conflictos
con relevancia jurídica. Estructurales porque la ubicación geográfica de la principal
entidad que administra justicia que es el Poder Judicial se encuentra en la capital de la
provincia y un Juzgado de Paz Letrado en el distrito de Tinta, cuenta con un número
reducido de Jueces y no cuenta con la suficiente logística para acercarse a las
comunidades alejadas de la provincia; Sociales como la lingüística por ser Quechua
hablantes, económica por tener bajos recursos económicos, educativa por no saber leer
y/o escribir y finalmente la discriminación que reciben por su vestimenta, religión, raza,
sexo y nivel económico; y finalmente ideales por la forma de pensar que presentan los
pobladores cuando se enfrentan a conflictos con relevancia jurídica.
Las consecuencias que generan las limitaciones de acceso a la administración de justicia
a los pobladores de las comunidades alejadas de esta provincia, son la desconfianza en
la administración de justicia del Poder Judicial, el abuso de poder por parte de las autoridades que administran justicia y finalmente los pobladores ya tomaron y quieren
seguir tomando justicia por sus propias manos. | es_PE |

within it, all members of society have the same rights, the right to access to the
administration of justice is recognized in the Constitution and in international treaties of
which the Peruvian State is a party, the Peruvian territory is divided into regions
provinces, districts, towns, communities, annexs, sectors, neighborhood, etc. The
Canchis province is one of the thirteen provinces of the department of Cusco, has 8
districts, 110 communities, and a number of centers, annexs and sectors.
The inhabitants of remote communities in the province of Canchis, still taking social
and structural constraints to access to the administration of justice, to exercise their right
of access to justice, to receive a due process and finally receive an effective judicial
protection to troubleshoot and repair their conflicts with legal relevance. Structural
because the geographic location of the main entity that administers justice, which is the
Judicial Power is located in the capital of the province and a Justice of the Peace Court
Counsel in the district of ink, with a small number of Judges and do not have sufficient
logistics to get closer to remote communities in the province; social projects, such as the Quechua speaking to be linguistic, economic to have low economic resources,
educational by not knowing how to read and/or write and finally the discrimination they
receive for their clothing, religion, race, gender and economic level.
The consequences that generate the limitations of access to the administration of justice
to the people of remote communities of this province, are the distrust in the
administration of justice of the Judiciary, the abuse of power by the authorities who
administer justice and finally the villagers have already taken and want to continue
