Los derechos de los ciudadanos y la obligatoriedad del voto en la constitución política del Perú.

Abstract

Durante la vida política del Perú a lo largo de la historia, hemos advertido el problema acerca de la imposicióndel votoa los ciudadanos, a fin de elegir a los representantes durante un periodo de tiempo, sin embargo, este tema trae consigo la falta de conciencia en los electores, al elegir a un representante sin la plena convicción de los ideales políticos del mismo, siendo el motivo principal para emitir su voto, la sanción pecuniaria por ser omiso en los procesos electorales y las consecuenciasaccesorias que lleva consigo, como son lasrestriccionesciviles, comerciales, administrativas y judiciales por incumplir con el deber de votar, lo que significaría la muerte civil. En esta línea de ideas, la presente investigaciónse basa en el análisis de la obligatoriedad del voto en el sistema electoral peruano, siendo reconocido como tal, en la Constitución Política del Perú, en el artículo 31°.Por lo tanto, la investigación incideenanalizar los aspectos más importantes queconlleva la obligatoriedad del voto, y las consecuencias negativas que trae consigo, siendo el principal la vulneración de derechosfundamentales como ser humano y como ciudadano parte de un Estado Democrático de Derecho, los cuales se determinarán duranteelproceso de análisis a realizase. Ahora, la técnica para realizar la investigación corresponde al análisis exegético y dogmático, obteniendo información de distintas fuentes doctrinarias y normas internacionales de cumplimiento obligatorio para los estados miembros, respecto a las categorías de estudio que son la violación de derechos y la obligatoriedad del voto, teniendo como objetivo principal identificar los derechos lesionados y con ello se planteará la necesidad de una reforma Constitucional, respecto del artículo 31°, que contempla el voto obligatorio e integrando el voto facultativo o voluntario.

During the political life of Peru throughout history, we have noticed the problem about the imposition of the vote to the citizens, in order to elect the representatives during a period of time, however, this issue brings with it the lack of conscience in the electors, when electing a representative without the full conviction of the political ideals of himself, being the main reason for giving his vote, the economic sanction for being disregarded in the electoral processes and the incidental consequences that it carries such as the civil, commercial, administrative and judicial restrictions for failing to comply with the duty to vote, which would mean civil death. In this line of ideas, the present investigation is based on the analysis of the obligatory nature of the vote in the peruvian electoral system, being recognized as suchlike, in the Political Constitution of Peru, in article 31. Therefore, the investigation resides in analyze the most important aspects that it carries the obligatoriness of the vote, and the negative consequences that it brings, being the main one of them the violation of fundamental rights as a human being and as a citizen of a Democratic State of Law, which will be determined during the process of analysis to be done. Now, the technique to accomplish the investigation corresponds to the exegetical and dogmatic analysis, obtaining information from different doctrinal sources and international norms of obligatory fulfillment for the member states, regarding to the categories of study that are the violation of rights and the compulsiveness of the vote, having as main objective to identify the injured rights and with it the need for a Constitutional reform, regarding to article 31, which contemplates compulsory vote and integrating the facultative or voluntary vote.
