Derecho a una filiación basada en la identidad biológica en caso de niños nacidos fuera del matrimonio de mujer casada, en el Perú.

Abstract

La situación actual de la legislación peruana en cuanto a la filiación de hijos extramatrimoniales deben motivar una reforma de los dispositivos legales vinculados a la contestación de la paternidad en virtud al avance de la ciencia y la tecnología que permiten hoy conocer con un alto grado de certeza la paternidad de las personas. Es derecho de todo niño a conocer quiénes son sus padres, y que en su partida de nacimiento aparezca consignado el nombre de sus verdaderos padres, no es otra cosa que la manifestación concreta del derecho que tiene todo sujeto a su propia identidad personal, derecho que está reconocido en el artículo 2 inciso 1 de la Constitución Política del Estado, como un derecho fundamental de la persona, derecho que por ser consustancial a la persona humana, tiene carácter inalienable, perpetuo y oponible erga omnes. Sin embargo en la regulación actual se aprecia que este problema de vulneración del derecho constitucional a la identidad viene siendo examinado en algunos casos por los Jueces a través del control difuso; no obstante, esta figura es una facultad y no una obligación del Juez por tanto no está investida del carácter obligatorio, pudiendo no ser aplicada lo cual genera una grave afectación al derecho a la identidad basada en la realidad biológica. Son estas consideraciones las que motivan realizar la presente investigación con el fin de identifica fundamentos que motiven y orienten al cambio de legislación en cuanto al derecho de filiación basada en la realidad biológica como una manifestación de respeto al derecho de identidad y al principio superior del niño.

The current situation of the Peruvian legislation regarding the filiation of extramarital children should motivate a reform of the legal devices related to the answer of paternity by virtue of the advance of science and technology that allow today to know with a high degree of certainty the paternity of the people. It is the right of every child to know who their parents are, and that in their birth certificate the name of their true parents is recorded, it is nothing else than the concrete manifestation of the right that every subject has to their own personal identity, a right that it is recognized in article 2, subsection 1 of the Political Constitution of the State, as a fundamental right of the person, a right that, because it is inherent to the human person, has an inalienable, perpetual and opposable character erga omnes. However, in the current regulation it is appreciated that this problem of violation of the constitutional right to identity is being examined in some cases by the Judges through diffuse control; However, this figure is a faculty and not an obligation of the Judge therefore is not vested with the mandatory nature, and may not be applied which generates a serious effect on the right to identity based on biological reality. It is these considerations that motivate the conduct of the present investigation in order to identify grounds that motivate and guide the change of legislation regarding the right of filiation based on biological reality as a manifestation of respect for the right of identity and the superior principle of the child.
