Problemática existente por la superposición de derechos entre la propiedad y la concesión minera en el Perú.

Abstract

La problemática de la superposición de derechos entre los propietarios del terreno superficial y los titulares mineros empieza con el sistema de dominio minero que predomina en nuestro país, siendo este el sistema dominialista regalista que hace una clara diferenciación entre estos, reconociendo la propiedad de los recursos minerales para el estado siendo este el encargado de otorgarlos en concesión.

Es a partir de este hecho que se generan diferentes conflictos sociales en nuestro país, toda vez que para empezar a realizar actividades mineras es necesario obtener el permiso de los propietarios del terreno superficial, siendo este hecho difícil de conseguir.

Tenemos que mencionar que en nuestro país ejerce actividades mineras desde épocas ancestrales, nuestros antepasados los incas desarrollaban esta actividad y a lo largo de nuestra historia siempre estuvo presente.

En la actualidad el potencial minero de nuestro país es enorme, el mismo que debe ser aprovechado, en los últimos tiempos se ha podido observar que a consecuencia de los conflictos sociales generados se paralizo proyectos mineros de gran envergadura, lo mismo que perjudico a la economía nacional.

Por lo que la presente investigación busca dar un mejor entendimiento sobre el tema, en aras de proponer medidas, alternativas y soluciones ante la deficiente aplicación de nuestra normativa respecto del tema que se desarrolló en el presente trabajo de investigación.

The problem of the superposition of rights between the owners of the surface land and the mine owners begins with the system of mining dominance that prevails in our country, this being the regalist system that makes a clear distinction between these, recognizing the ownership of resources minerals for the state being this one in charge of granting them in concession.

It is from this fact that different social conflicts are generated in our country, since to start mining activities it is necessary to obtain the permission of the owners of the surface land, this fact being difficult to achieve.

We have to mention that in our country it has been carrying out mining activities since ancient times, our ancestors the Incas developed this activity and throughout our history it was always present.

Currently the mining potential of our country is huge, the same that should be exploited, in recent times it has been observed that as a result of social conflicts generated paralyze largescale mining projects, the same thing that harmed the economy national.

Therefore, the present investigation seeks to give a better understanding on the subject, in

order

to propose measures, alternatives and solutions to the deficient application of our regulations with respect to the topic that was developed in this research work.
