dc.description.abstractEl presente trabajo de investigación desarrolla temas suscitados al contexto de la percepción de impunidad rampante que los ciudadanos peruanos tienen respecto a la justicia. Hoy en día, ningún miembro de la Iglesia católica peruana ha sido condenado por abuso sexual a menores a pesar de la abundante evidencia presentada por víctimas y comisiones investigadoras. A nivel nacional, solo existe una investigación judicial contra algunos miembros de la organización cristiana “Sodalitium Christianae Vitae” en la ciudad de Lima. Una investigación, por cierto, llena de vicios y retrasos. Esta tesis pretende analizar si el derecho internacional tendría un papel relevante al momento de investigar los casos de abusos sexuales en el Perú. La principal interrogante de la investigación es ¿Podría la Corte Penal Internacional investigar a los máximos representantes de la Iglesia Católica en el Perú? Esta interrogante se basa en la suposición de que los crímenes de abuso sexual de menores cometidos por miembros de la Iglesia Católica peruana podrían ser considerados como crímenes de lesa humanidad, por lo tanto, sus máximos representantes tendrían responsabilidad de mando y podrían ser investigados por la Corte Penal Internacional. Para esto, la tesis tiene como objetivos: Investigar si los máximos representantes de la Iglesia Católica en el Perú podrían ser investigados por la Corte Penal Internacional, inquirir bajo que bases legales la Corte Penal Internacional podría investigar a los máximos representantes de la Iglesia Católica en el Perú, explicar de qué manera los casos de abuso sexual de menores en el Perú podrían ser considerados crímenes de lesa humanidad, y estudiar si el Estado Peruano tiene un récord positivo o negativo en su disposición a investigar fehacientemente los casos de abusos sexuales a menores dentro de su jurisdicción. El cuerpo de la tesis está dividido en 4 capítulos. El primero es la introducción, donde se mencionan las interrogantes, objetivos y justificación de la tesis. El segundo capítulo se refiere al marco teórico. Este capítulo está dividido en 3 subsecciones: La Corte Penal Internacional, Crímenes de Lesa Humanidad, y las investigaciones realizadas por el Estado peruano sobre abusos sexuales a menores. Cada una de estas subsecciones está relacionada a un objetivo (e hipótesis) especifico. El tercer capítulo se refiere al diseño metodológico utilizado en la tesis. Finalmente, el cuarto capítulo presenta los resultados de la investigación. Los resultados de la investigación arrojan que no es posible que los máximos representantes de la Iglesia Católica peruana sean investigados por la Corte Penal Internacional en el contexto que rodea la situación peruana en estos momentos. Hace falta una investigación a nivel nacional para saber si crímenes de lesa humanidad fueron cometidos. A pesar de esto, se puede argumentar que la situación peruana podría pasar la primera fase de la Corte que evalúa la jurisdicción y que evalúa la admisibilidad. Como ya se mencionó, esto está sujeto a una investigación previa a nivel nacional que indique el número aproximado de víctimas de abuso por parte de miembros de la Iglesia Católica peruana. Además, existen elementos que dan a entender que sí se podrían considerar como crímenes de lesa humanidad a los abusos sexuales perpetuados por miembros de la Iglesia Católica peruana. Se puede considerar al caso del Sodalicio como parte de un ataque generalizado y/o sistemático a nivel nacional. Finalmente, la investigación esclarece el hecho de que, a pesar de algunos esfuerzos positivos por parte del Estado peruano en la investigación de abusos sexuales a menores por parte de miembros de la Iglesia católica, no existen esfuerzos serios para combatir los abusos. El Estado peruano ha tomado pasos manifiestamente insuficientes en las investigaciones de abusos sexuales a menores por parte de miembros de la Iglesia Católica, ha ignorado evidencia, o le ha dado insuficiente valor, no tiene intención de traer al presunto autor (autores) ante la justicia, y ha alocado recursos insuficientes para los procedimientos. Hoy endía, no existe una movilización de carácter serio y nacional impulsada por el Estado para investigar los casos de abusos sexuales a menores.es_PE
dc.description.abstractThis research develops themes subject to the context of the perception of impunity that Peruvians have regarding justice. As of today, no member of the Peruvian Catholic Church has been condemned for sexual abuse of minors regarding the abundant evidence presented by the victims and inquire commissions. At the national level, there is only one prosecution being held against some members of the Cristian organization “Sodalitium Christianae Vitae” in the city of Lima. This prosecution has had many problems and delays. This thesis Will analyze the role of international law in the investigations of sexual abuse in Peru. The main research question is: Could the International Criminal Court investigate the highest representatives of the Peruvian Catholic Church? This research question assumes that the sexual abuse to minors committed by members of the Peruvian Catholic Church could be crimes against humanity, so, the highest representatives could have command responsibility and could be investigated by the International Criminal Court. This research has the following objectives: To investigate if the highest representatives of the Peruvian Catholic Church could be investigated by the International Criminal Court, to inquire under which basis the International Criminal Court could investigate the highest representatives of the Peruvian Catholic Church, to explain how the sexual abuse cases in Peru could be considered crimes against humanity, and to study if the Peruvian government has a positive or negative record regarding investigations of sexual abuse cases inside its jurisdiction. The body of the thesis is divided into 4 chapters. The first is the introduction, where the questions, objectives and justification of the thesis are mentioned. The second chapter refers to the theoretical framework. This chapter is divided into 3 subsections: The International Criminal Court, Crimes against Humanity, and the investigations conducted by the Peruvian State on sexual abuse of minors. Each of these subsections is related to a specific objective (and hypothesis). The third chapter refers to the methodological design used in the thesis. Finally, the fourth chapter presents the results of the investigation. The results of the investigation show that it is not possible for the highest representatives of the Peruvian Catholic Church to be investigated by the International Criminal Court in the context surrounding the Peruvian situation now. A nationwide investigation is needed to find out if crimes against humanity were committed. Despite this, it can be argued that the Peruvian situation could pass the first phase of the Court that evaluates the jurisdiction and admissibility. As already mentioned, this is subject to a previous investigation at a national level that indicates the approximate number of victims of abuse by members of the Peruvian Catholic Church. In addition, there are elements that suggest that sexual abuses perpetuated by members of the Peruvian Catholic Church could be considered crimes against humanity. The Sodalicio case can be considered as part of a generalized and / or systematic attack at the national level. Finally, the investigation clarifies the fact that, despite some positive efforts on the part of the Peruvian State in the investigation of sexual abuse of minors by members of the Catholic Church, there are no serious efforts to combat the abuses. The Peruvian State has taken manifestly insufficient steps in investigations of sexual abuse of minors by members of the Catholic Church, has ignored evidence, or has given insufficient value, has no intention of bringing the alleged perpetrator (authors) to justice, and has allocated insufficient resources for the procedures. Today, there is no mobilization of serious and national character driven by the State to investigate cases of sexual abuse of minors.en_US
