Despenalización del aborto en casos de mujeres víctimas de violación sexual.

Abstract

En el presente trabajo de investigación referido a tema “DESPENALIZACIÓN DEL ABORTO EN CASOS DE MUJERES VICTIMAS DE VIOLACIÓN SEXUAL”, por el cual se ve involucrada aquella mujer en estado de gestación donde es producto de una violación y por ese hecho degradante que trae consigo consecuencias referido a estado de salud muy graves y está en la necesidad y que dicha necesidad debería de ser una opción refiriéndonos al hecho de abortar porque de lo contrario se estaría vulnerado y dejando de lado los derechos fundamentales como es el de la dignidad, integridad física y psicológica y más que todo el de la salud. El interés de tocar este tema de investigación los desarrollare básicamente en el derecho a la vida donde veremos al nuevo ser que está en camino y el derecho a la dignidad de aquella mujer embarazada que fue víctima de una violación sexual donde la penalización de este peculiar tipo de aborto estaría dañando el derecho de este que es el de la dignidad como persona humana, donde este derecho fundamental abarca todos los derechos. En este tema de investigación sustentamos que la despenalización es una adecuad opción que pertenece exclusivamente a aquellas mujeres que fueron o puedan ser víctimas de violación sexual seguidas por este de un embarazo no deseado y de esa forma tratar que nuestra sociedad se sea más racional y humanista. Este trabajo de investigación tiene como objeto la despenalización de este tipo de aborto y por ende plantearemos argumentos y una propuesta legislativa para despenalizar el aborto por violación sexual.

In the present work of investigation referred to subject “DEPENALIZATION OF ABORTION IN CASES OF WOMEN VICTIMS OF SEXUAL VIOLATION “, by which it is involved that woman in gestation state where it is product of a violation and for that degrading fact that brings with it consequences referred to health condition very serious and this in need and that this need should be an option referring to the fact of abortion because otherwise it would be violated and leaving aside fundamental rights such as dignity, physical and psychological integrity and more than all health .The interest of touching this research topic will be developed basically in the right to life where we will see the new being that is on the way and the right to the dignity of that pregnant woman who was the victim of a sexual violation where the criminalization of this peculiar type of abortion would be damaging the right of this which is that of dignity as a human person, where this fundamental right encompasses all rights. In this research topic we argue that decriminalization is an adequate option that belongs exclusively to those women who were or may be victims of rape followed by this of an unwanted pregnancy and thus try to make our society more rational and humanistic .This research work has the purpose of decriminalizing this type of abortion and therefore we will raise arguments and a legislative proposal to decriminalize abortion for rape.
