La ejecución de oficio de las medidas socioeducativas impuestas a los menores infractores a la ley penal, como manifestación del derecho a la tutela jurisdiccional efectiva. (Propuesta Legislativa)

Abstract

El presente trabajo de investigación vamos a fundamentar nuestra problemática que día a día va en aumento, ya que aún no existe algún tipo de normativa legal que tipifique esta problemática de índole social y jurídica; nos referimos a la ejecución de oficio de las medidas socioeducativas impuestas a los menores infractores a la ley penal, como manifestación de la Tutela Jurisdiccional Efectiva. Capítulo I, está referido al problema y los aspectos metodológicos del estudio que se aborda en el trabajo. El Capítulo II, recaba los antecedentes de la tesis. Anteriores investigaciones realizadas por otros autores que coadyuvan a la presente investigación. El Capítulo III, profundiza los temas preliminares que, también son fundamentales para ir entendiendo el problema en toda su amplitud; este capítulo trata sobre la tutela jurisdiccional efectiva, su regulación Nacional e Internacional, definición de Tutela Jurisdiccional efectiva; así como sus elementos: la jurisdicción, debido proceso y ejecución de sentencia; y los aspectos relevantes de la tutela jurisdiccional efectiva. El Capítulo IV, trata del proceso penal a menores infractores a la ley penal, legislación, concepto de menor infractor, principios estructurales, jurisdicción y competencia; por último, la investigación y juzgamiento. El Capítulo V, hace un análisis más profundo sobre nuestro problema. Se desarrolla el tema de las sanciones a adolescentes infractores, medidas socioeducativas y su definición, las clases de medidas socioeducativas como son: amonestación, libertad asistida, prestación de servicios a la comunidad y reparación directa a la víctima. El Capítulo VI, analiza de manera integral el tema de tratamiento de ejecución de las resoluciones judiciales; siendo el estudio de éste indispensable para abordar la problemática, principio de efectividad de la sentencia, fines de las medidas socioeducativas en la justicia penal para adolescentes, relación entre tutela jurisdiccional y ejecución de oficio, el juez de familia en la ejecución de medidas socioeducativas y el procedimiento jurisdiccional de ejecución. El Capítulo VII, fundamenta el por qué es posible esta propuesta legislativa sobre la ejecución de oficio de las medidas socioeducativas impuestas a los menores infractores a la ley penal. El Capítulo VIII, plantea y /o argumenta la propuesta del proyecto de ley, en el cual debe existir un artículo en nuestro Código de los niños y adolescentes.

The present research work is going to base our problems that day by day is increasing, since there is still no type of legal regulation that typifies this problem of social and legal nature; we refer to the ex officio execution of the socio-educational measures imposed on juvenile offenders to the criminal law, as a manifestation of the Effective Jurisdictional Guardianship. Chapter I, is referred to the problem and the methodological aspects of the study that is addressed in the work. Chapter II, collects the background of the thesis. Previous research carried out by other authors that contribute to the present investigation. Chapter III, deepens the preliminary issues that are also fundamental to understand the problem in its full extent; this chapter deals with the effective jurisdictional protection, its National and International regulation, definition of effective Jurisdictional Guardianship; as well as its elements: jurisdiction, due process and execution of sentence; and the relevant aspects of effective jurisdictional protection. Chapter IV, deals with criminal proceedings against juvenile offenders to the criminal law, legislation, juvenile offender concept, structural principles, jurisdiction and competence; finally, the investigation and judgment. Chapter V, makes a deeper analysis about our problem. The issue of sanctions for adolescent offenders, socioeducational measures and their definition, the types of socio-educational measures such as: warning, assisted freedom, rendering services to the community and direct reparation to the victim is developed. Chapter VI, analyzes in a comprehensive manner the issue of treatment of execution of judicial decisions; being the study of this indispensable to address the problem, the principle of effectiveness of the sentence, the purpose of socio-educational measures in criminal justice for adolescents, relationship between jurisdictional protection and ex officio enforcement, the family judge in the implementation of socio-educational measures and the jurisdictional procedure of execution. Chapter VII, is the basis for why this legislative proposal on the ex officio enforcement of socio-educational measures imposed on juvenile offenders to criminal law is possible. Chapter VIII, raises and / or argues the proposal of the bill, in which there must be an article in our Code of children and adolescents.
