dc.description.abstractLa inconstitucionalidad de la tesis colisionista en los casos difíciles del tribunal constitucional peruano: caso N° 00011-2013-AI/TC y caso N° 06712-2005-HC/TC. La presente investigación se basó en el desarrollo actual de la teoría constitucional derechos fundamentales, específicamente en el entendimiento del conflicto que se genera cuando dos derechos interaccionan en un caso concreto, jerarquizándose un derecho fundamental sobre otro, este entendimiento vulnera los principios constitucionales de unidad y coherencia. Con la finalidad de buscar una solución al problema planteado, en la presente investigación, se propone hacer uso de la tesis delimitacionista de derechos fundamentales. La presente tesis está enmarcada en el tipo de investigación aplicada confirmatoria, a nivel cualitativo, se emplearon una serie de técnicas e instrumentos de recolección de datos, específicamente el análisis de fuentes documentales y doctrinales y jurisprudencia constitucional. Para le elaboración del tema y cumplimiento de los objetivos se realizó el análisis de dos casos específicos, los cuales nos ayudaron a identificar el problema y plantear la solución propuesta. De esta manera se pudo determinar la inscontitucional de la tesis colisionista en los casos difíciles de Tribunal Constiticional y la aplicación de la tesis delimitacionista como solución, siendo imposible la limitación de derechos, y respectivamente la contradicción o confrontación de los mismos. Por lo tanto el contenido de los derechos fundamentales es uno solo; un solo contenido constitucional. Debiéndose buscar siempre una interpretación armónica que procure una única respuesta correcta posible.es_PE
dc.description.abstractThe unconstitutionality of the collisionist thesis in the difficult cases of the Peruvian constitutional court: case Nº 00011-2013-AI / TC and case Nº 06712-2005-HC / TC. The present research is based on the current development of constitutional theory and fundamental rights specifically in the context of the conflict that arises when rights interact in a specific case hierarchizing a fundamental right over another, this understanding gainsay to the constitutional values of unity and coherence. In order to find a solution to the problem displayed, in the present investigation, I propose to make use of the harmonic thesis of fundamental rights. This thesis is framed in the type of confirmatory applied researches in whom I describe the different qualities of the investigation using series of data collection techniques and devices, specifically the analysis of documentary and doctrinal sources and constitutional jurisprudence. For the elaboration of the topic and fulfillment of the objectives the analysis of specific cases was carried out, which were used to identify the problem and the proposed a solution. Finally, it was possible to determine the unconstitutionality of the collisionist thesis in the difficult cases of the Constitutive Court and the application of the delimiting thesis as a solution, being impossible the limitation of the rights, and then the contradiction or confrontation of the same. Therefore, the content of fundamental rights is only one; a single constitutional content. We must always look for a harmonic interpretation that procures a single possible correct answer.en_US
