Violación sexual de menor de edad y el instituto de la prescripción por el transcurso del tiempo.

Abstract

La investigación tiene por finalidad determinar que la política criminal del Estado para la prevención de los delitos de Violación sexual de menor de edad, no es el adecuado puesto que a diario las víctimas de estos actos siguen creciendo. En nuestro ordenamiento jurídico el delito de violación sexual así como otros delitos también prescribe por el transcurso del tiempo. Sin embargo en otros países como EE.UU, Suecia, México y otros. Este por tratándose de un delito contra menores de edad es considerado imprescriptible. Lo que permite que sin importar el transcurso del tiempo el Estado perseguirá al responsable hasta lograr que sea sancionado por el delito que cometió. Sin embargo, en nuestra sociedad esto no es así, en muchos casos las víctimas por ser estos menores de edad, muchas veces no denuncian la situación por lo que pasaron, ya sea por que hayan sido amenazados, por temor, por miedo u otras razones. Y al momento que estos adquieren conciencia de lo que les paso, deciden denunciar tal acto, sin embargo al momento de realizar la denuncia, este delito ya prescribió por el transcurso del tiempo. Vulnerando así los derechos de la víctima. Es por ello que en este trabajo, proponemos que los delitos de violación sexual de menores de edad, sea un delito Imprescriptible. Con ello lograremos que se respeten los derechos de los niños y niñas víctimas de violencia sexual y sobretodo lograremos que se haga justicia y que los responsables paguen por sus delitos.

However, in our society this is not the case, in many cases the victims because they are minors, often do not report the situation because of what happened, either because they have been threatened, because of fear, fear or other reasons. And when they become aware of what happened to them, they decide to denounce such an act, however at the time of making the complaint, this crime has already prescribed for the passage of time. Infringe the rights of the victim. That is why in this work, we propose that the crimes of sexual violation of minors, is an impossible crime. This will ensure that the rights of children who are victims of sexual violence are respected and, above all, that justice is achieved and that those responsible are paid for their crimes.
