La ejecución contractual en la gobernatura regional del Cusco y la Ley de contrataciones del Estado periodo 2016.

Abstract

El presente estudio tiene como objetivo general identificar como afectan las deficiencias que existen en la Ley de Contrataciones del Estado en la fase de ejecución contractual en obras mediante licitación pública en la Gobernatura Regional del Cusco, durante el periodo 2016. El estudio comprende la hipótesis que estas deficiencias afectan de manera significativa en la fase de ejecución contractual en obras mediante licitación pública en la Gobernatura Regional del Cusco, Ocasionando la comisión de delitos por parte de los funcionarios públicos encargados en la contrataciones esto debido a la falta de regulación eficiente de la Ley de Contrataciones del Estado en especial en el tema de supervisión de obras por parte de las entidades. Además que tales deficiencias traen como consecuencia la comisión de actos de corrupción por parte de los funcionarios encargados, mayores costos al término de las obras y en algunos casos por la falta de supervisión y fiscalización ocasionan obras mal ejecutadas. Y que la actuación de los representantes del Gobierno Regional, en la etapa de ejecución contractual infiere en el cumplimiento de la normativa sobre contrataciones con el Estado, porque no tienen un conocimiento a fondo en materia de contrataciones estatales. Así mismo sus actuaciones están direccionadas a la satisfacción propia y de terceros más no al cumplimiento de la finalidad pública. Para el trabajo de campo, se realizó con una muestra de 10 resoluciones contenidas en el expediente de liquidación de obras de la Gerencia Regional de Infraestructura. Así como las encuestas realizadas a funcionarios de la Gobernatura Regional del Cusco. El estudio realizado servirá de base para que otros investigadores continúen profundizando sobre el tema, como fundamento de propuestas para lograr un adecuado control y transparencia en las contrataciones públicas, y de esta manera mejorar la eficiencia, eficacia, economía y asegurar el cumplimiento de las metas institucionales en las Gobernaturas Regionales con el fin público.

The present study has as general objective to identify how they affect the deficiencies that exist in the Law of State Contracts in the stage of contractual execution in works by means of public licitation in the Regional Government of Cusco during the period 2016. The study includes the hypothesis that these deficiencies affect significantly in the stage of contractual execution in works through public bidding in the Regional Government of Cusco, causing the commission of crimes by public officials in charge of contracting this due to lack of efficient regulation of the Law on State Contracting, especially in the subject of supervision of works by the entities. In addition, such deficiencies result in the commission of acts of corruption by the officials in charge, higher costs at the end of the works and in some cases because of the lack of supervision and control, they cause poorly executed works. And that the actions of the representatives of the Regional Government, in the stage of contractual implementation infers in the compliance with the regulations on contracting with the State, because they do not have an in-depth knowledge on state contracting. Likewise, its actions are aimed at self-satisfaction and of third parties, but not at the fulfillment of the public purpose. For the field work, it was carried out with a sample of 10 resolutions contained in the file of liquidation of works of the Regional Infrastructure Management. As well as the surveys conducted to officials of the Regional Government of Cusco. The study will serve as a basis for other researchers to continue to deepen the subject, as a basis for proposals to achieve adequate control and transparency in public procurement, and thereby improve efficiency, effectiveness, economy and ensure compliance with the goals institutions in the Regional Governments for the public purpose.
