dc.description.abstractUna gran polémica acerca del sistema de transferencia de propiedad inmueble se ha ido desarrollando en nuestro país. Tiene como antecedente principal al Código Civil de 1852 en el cual se dio nacimiento a un debate doctrinario, que se ha prolongado hasta la fecha, ya que en dicho cuerpo normativo se acogió por vez primera un sistema que regularía la transferencia de propiedad inmueble, optándose por importar del Código Napoleónico de 1804 el sistema denominado francés, del simple consenso o espiritual, por el que basta solo el acuerdo de las partes (consentimiento) para dar por efectuada o transferida la propiedad de un bien inmueble. Esta adopción legislativa se ha mantenido en los dos Códigos Civiles subsiguientes, el de 1936 y el de 1984. Sin embargo existen numerosas posiciones sobre el sistema adoptado y las desventajas que este presenta sobre todo, en la inseguridad jurídica que presenta, ya que las transferencias de inmuebles no resulta siendo únicamente interés de las partes intervinientes, sino que dado el contexto social, tiene amplia relevancia ; siendo necesario que terceros que no participaron en el contrato, asuman el conocimiento que se produjo la transferencia de propiedad hacia otra persona, con el fin de garantizar la seguridad jurídica y esta se desarrolle con la transparencia y confiabilidad que todo modelo socio-económico requiere para el tráfico inmobiliario. Entonces la seguridad jurídica que ofrece este sistema tiene menos garantías, que los modelos en los cuales se exige la inscripción registral para trasmitir el derecho, es por ello que desarrollaremos las principales deficiencias que trae consigo el sistema consensualista, y estudiando la conveniencia o inconveniencia de modificar hoy en día el sistema de trasferencia de propiedad regente en el Perú.es_PE
