Separación conyugal de padres y responsabilidad penal de adolescentes de 14 a 18 años en el distrito de Sicuani, provincia de Canchis, región Cusco, 2022

Abstract

En la presente tesis de título “SEPARACION CONYUGAL DE PADRES Y RESPONSABILIDAD PENAL DE ADOLECENTES DE 14 A 18 AÑOS EN EL DISTRITO DE SICUANI, PROVINCIA DE CANCHIS, REGION CUSCO, 2022.” Investigación del cual se prevé que la separación conyugal y la responsabilidad penal en adolescentes tienen relación. Por tal motivo se ha desarrollado el estudio de alcance descriptivo, de diseño no experimental, donde se tuvo como una población de estudio a los adolescentes de 14 a 18 años de edad, de ambos géneros, que viven en el distrito de Sicuani, provincia de Canchis, región Cusco, donde finalmente después de aplicar los criterios de exclusión y de inclusión se pudo obtener la información de 50 adolescentes entre varones y mujeres, también se aplicó la encuesta complementaria a los expertos en el tema, utilizando el método de la encuesta para recopilar datos. Los hallazgos demuestran como la separación conyugal es uno de los factores a tomar en cuenta, en la responsabilidad penal de los adolescentes en el distrito de Sicuani, tal como se precisa en la mayoría de los encuestados considera que la responsabilidad penal, cuando hay alguna acusación o sentencia se debe tener en cuenta los factores o causas que llevaron a cometer el delito por parte de los adolescentes, en estos casos la separación conyugal de los padres, problemas económicos, conflictos familiares, consumo de drogas y alcohol. Un poco menos de la mitad de los expertos encuestados, están en desacuerdo que los factores sociales como la separación conyugal sean causas de delitos efectuados por adolescentes y también en caso de la responsabilidad penal que no deberían tomarse en cuenta estos factores. Finalmente, la responsabilidad penal si tienen relación con la separación conyugal de los padres de los adolescentes que han cometido algún tipo de delito.

In this thesis titled "MARIVAL SEPARATION OF PARENTS AND CRIMINAL LIABILITY OF ADOLESCENTS AGED 14 TO 18 IN THE DISTRICT OF SICUANI, PROVINCE OF CANCHIS, CUSCO REGION, 2022." For this reason, the study of descriptive scope, of non-experimental design, has been developed, where adolescents from 14 to 18 years of age, of both genders, who live in the district of Sicuani, province of Canchis, Cusco region, where finally after applying the exclusion and inclusion criteria it was possible to obtain the information of 50 adolescents between men and women, the complementary survey was also applied to the experts on the subject, using the survey method to collect data. The findings show how marital separation is one of the factors to take into account, in the criminal responsibility of adolescents in the Sicuani district, as specified in the majority of respondents consider that criminal responsibility, when there is an accusation or sentence, the factors or causes that led adolescents to commit the crime must be taken into account, in these cases the marital separation of the parents, economic problems, family conflicts, drug and alcohol use. A little less than half of the experts surveyed disagree that social factors such as marital separation are causes of crimes committed by adolescents and also in the case of criminal responsibility that these factors should not be taken into account. Finally, criminal liability if they are related to the spousal separation of the parents of adolescents who have committed some type of crime.
