El presupuesto de la Municipalidad Distrital de Wanchaq y la reposición laboral - periodo 2011-2015.

Abstract

El proceso judicial de reposición laboral que inician trabajadores del sector público tiene acogida en el Poder Judicial, contraviniendo el marco normativo en relación a la administración de los recursos humanos y el presupuesto para el gasto por remuneraciones. La ley del presupuesto público establece prohibiciones para la modificación del presupuesto asignado para el pago de remuneraciones. Esta situación obliga a las municipalidades a modificar su presupuesto de gasto corriente para incluir los cargos de los trabajadores repuestos y, en otros casos a modificar el presupuesto de los proyectos de inversión a los que se afectará las remuneraciones de los demandantes repuestos. La Municipalidad Distrital de Wanchaq, al igual que la mayoría de las municipalidades de la región y el país, se ve obligada a reponer a trabajadores de los regímenes laborales establecidos por el Decreto Legislativo N° 276 Ley de Bases de la Carrera Administrativa y el Decreto Legislativo N° 728 Régimen Laboral de la Actividad Privada, por sentencia de los juzgados. El estudio pretende establecer la incidencia de la reposición laboral, por sentencia judicial, en el presupuesto de la Municipalidad Distrital de Wanchaq. La presente investigación tipo descriptivo no experimental y corresponde a un enfoque cuantitativo. La población y la muestra están constituidas por el número de los trabajadores que han retornado a laborar a la Municipal Distrital de Wanchaq por reposición judicial en el periodo 2011 al 2015. Para obtener los datos se revisaron fuentes de información organizándolas por año y meta presupuestaria, utilizando fichas de análisis documental y de captura de datos y cuestionario para entrevistas. Se ha establecido un rango para calificar la afectación de las reposiciones laborales por disposición judicial. Del análisis de los resultados se ha concluido que el presupuesto de la Municipalidad Distrital de Wanchaq del ejercicio 2015 se ha incrementado en 65.91% por causa de las reposiciones laborales por disposición judicial producidas en el periodo 2011- 2015, lo que implica que se ha visto afectado de manera significativa, generando la aplicación irregular del marco normativo en materia presupuestal y la ineficiencia en la ejecución de su presupuesto.

The judicial process for reinstatement initiating public sector workers have received in the judiciary, in contravention of the regulatory framework regarding the management of human resources and budget for the salary expense. The law bans public budget set for changing the budget allocated for the payment of remuneration.

This situation obliges municipalities to change their current spending budget to include charges of spare parts workers and in other cases to modify the budget investment projects that the remuneration of the applicants parts will be affected.

The District Municipality of Wanchaq, like most municipalities in the region and the country is forced to reinstate workers from occupational schemes established by Legislative Decree No. 276 Basic Law of the Civil Service and Decree legislative No. 728 Labour Scheme Private Activity, by judgment of the courts.

The study aims to establish the incidence of labor replacement, by court order, in the budget of the District Municipality of Wanchaq. This non-experimental descriptive research and corresponds to a quantitative approach. The population and the sample are constituted by the number of workers whohave returned to work at the District Municipal court Wanchaq replacement in the period 2011 to 2015.

For data sources they were reviewed by organizing information by year budget target, using sheets of document analysis and data collection questionnaire and interviews. Range has been established to qualify the involvement of labor rerunsfor justice.

Analysis of the results it was concluded that the budget of the District Municipality of Wanchaq the year 2015 has increased by 65.91% because of labor reruns for justice produced in the period 2011- 2015, which implies that has been significantly affected, creating the irregular application of the regulatory framework in budgetary matters and inefficiency in the implementation of its budget.
