Inconstitucionalidad de la Ley N°29618 frente al artículo 73 de la Constitución Política del Perú y la prescripción adquisitiva de bienes de dominio privado del Gobierno Regional del Cusco, 2014-2017

Abstract

El presente estudio “INCONSTITUCIONALIDAD DE LA LEY N° 29618 FRENTE AL ARTÍCULO 73° DE LA CONSTITUCIÓN POLÍTICA DEL PERÚ Y LA PRESCRIPCIÓN ADQUISITIVA DE BIENES DE DOMINIO PRIVADO DEL GOBIERNO REGIONAL DE CUSCO, 2014-2017” tiene como objetivo determinar en qué manera la Ley N° 29618 vulnera al artículo 73° de la Constitución Política de 1993 en relación a la prescripción adquisitiva de bienes de dominio privado del Gobierno Regional de Cusco el año 2014-2017. Con respecto a la metodología, corresponde el enfoque cualitativo, la investigación fue de tipo socio jurídica, con diseño transversal y de nivel descriptivo correlacional, dentro de la unidad de estudio se consideraron 4 expedientes para ser analizados mediante el instrumento denominado ficha de análisis documental. El escenario de estudio de la presente investigación corresponde al periodo comprendido entre los años 2014 al 2017. La técnica de investigación utilizada fue la ficha de análisis documental, realizada a 4 expedientes de forma detallada. Se concluye que en la muestra no se aplicó la Ley 29618 por lo que no se pudo evidenciar una vulneración del artículo 73 de la Constitución dado que el razonamiento, así como la fundamentación en las sentencias a nivel nacional con respecto a la Ley es variada, algunas regiones si la vienen aplicando y en otras como la analizada en la presente investigación no.

The present study "UNCONSTITUTIONALITY OF LAW N° 29618 AGAINST ARTICLE 73 OF THE POLITICAL CONSTITUTION OF PERU AND THE ACQUISITIVE PRESCRIPTION OF PRIVATE DOMAIN GOODS OF THE REGIONAL GOVERNMENT OF CUSCO, 2014-2017" aims to determine how the Law N° 29618 violates article 73 of the Political Constitution of 1993 in relation to the acquisitive prescription of private domain assets of the Regional Government of Cusco in the year 2014-2017. With respect to the methodology, the qualitative approach corresponds, the research was of a socio-legal type, with a cross-sectional design and a descriptive correlational level, within the study unit 4 files were considered to be analyzed using the instrument called documentary analysis sheet. The study scenario of this research corresponds to the period between 2014 and 2017. The research technique used was the documentary analysis sheet, carried out on 4 files in detail. It is concluded that Law 29618 was not applied in the sample, therefore it was not possible to demonstrate a violation of article 73 of the Constitution given that the reasoning, as well as the foundation in the sentences at the national level with respect to the Law is varied, Some regions have been applying it and in others, such as the one analyzed in this investigation, no.
