Factores de impedimento de inscripción del nacimiento y la afectación del derecho de igualdad del padre que procrea mediante técnicas de reproducción asistida 2022

Abstract

La presente investigación titulada: “Factores de impedimento de inscripción del nacimiento y la afectación del derecho de igualdad del padre que procrea mediante Técnicas de Reproducción Asistida, 2022”, tuvo como finalidad primordial: Analizar cuáles son los factores de impedimento de inscripción del nacimiento y la afectación del derecho de igualdad y no discriminación del padre que procrea mediante técnicas de reproducción asistida, Perú 2022, para ello se propuso como proceso metodológico un enfoque cualitativo, por lo cual se aplicaron como técnicas de investigación el análisis documental y la entrevista, como instrumentos se aplicaron una ficha de observación documental y una guía de entrevista abierta semiestructurada, aplicada a seis especialistas en la materia, tomados mediante el muestreo no probabilístico de carácter intencional o por conveniencia, aplicando los criterios de inclusión y exclusión establecidos para determinar la representatividad de la muestra; con respecto al análisis documental se encontraron once resoluciones entre nacionales e internacionales que tienen como eje principal los problemas y factores para el impedimento de inscripción del nacimiento y afectación del derecho de igualdad y no discriminación de los padres varones que conciben mediante técnicas de reproducción asistida, así como también la afectación del derecho a la identidad de los niños concebidos mediante las mismas. Tras el proceso de investigación se obtuvieron como resultados que el padre que se somete a procrear mediante las TERAS, se encuentra en una clara vulnerabilidad de los derechos de igualdad, dado que no se encuentra en la actualidad una norma específica sobre TERAS; así se concluye que las investigadoras consideraron que es fundamental ampliar el artículo 21 del Código Civil donde el padre pueda inscribir a sus hijos con sus dos apellidos mientras se desconoce la identidad de la madre, o bien, si el padre considera el anonimato de la misma.

The present investigation entitled: "Factors that prevent birth registration and the affectation of the right of equality of the father who procreates through Assisted Reproduction Techniques, 2022", had as its primary purpose: To analyze what are the factors that prevent birth registration and the affectation of the right of equality and non-discrimination of the father who procreates through assisted reproduction techniques, Peru 2022, for this purpose, a qualitative approach was proposed as a methodological process, for which documentary analysis and interviews were applied as research techniques, as instruments, a documentary observation sheet and a semi-structured open interview guide were applied, applied to six specialists in the field, taken by non-probabilistic sampling of an intentional or convenience nature, applying the inclusion and exclusion criteria established to determine the representativeness of the sample; Regarding the qualitative part, eleven national and international resolutions were found that have as their main axis the problems and factors for the impediment of birth registration and affectation of the right to equality and non-discrimination of male parents who conceive through assisted reproductive techniques. , as well as the affectation of the right to identity of children conceived through them. After the investigation process, the results obtained were that the father who commits himself to procreation through TERAS, finds himself in a clear vulnerability of the rights of equality, given that a specific norm on TERAS is not currently found; so it is concluded that the investigators considered that it is essential to change article 21 of the Civil Code where the father could inscribe his children with their two lastnames while the identity of the mother is unknown, well, if the father considers the anonymity of the mother .
