El contrato de maternidad subrogada sobre los derechos fundamentales del concebido en el Perú

Abstract

Durante la presente investigación nos enfocaremos sobre cuál es el mecanismo que se utiliza en los contratos de maternidad subrogada; para este estudio señalaremos el rol del estado peruano y las normas jurídicas nacionales que han llevado a salvaguardar la integridad de la mujer contratante y el contratado, entender cuál es el panorama para establecer un modelo o un orden jerárquico sobre los contratos de maternidad subrogada y este determine parámetros para la protección de la integridad tanto de la madre gestante y del contratante. Entendiendo este mecanismo de estudio podemos señalar la siguiente investigación con objetividad para evaluar y salvaguardar dicho derecho y de esta manera completar el núcleo de la familia o de la sociedad, como lo establece nuestra Constitución política, entendiendo de que todo ser humano tiene derecho a la reproducción, a tener una familia, y que esta nueva alternativa de embarazo asistido puede hacer una nueva generación donde padres y familias puedan llegar a alcanzar y completar el rol de la vida; con este mecanismo lo que buscamos es establecer cuál es el bien jurídico protegido respecto a la familia, si el bien jurídico protegido por el estado puede enmarcar un panorama diferente para salvaguardar a la acción antes de dicho contrato, por lo que en el Perú no existe aún este mecanismo para proteger a los contratantes.

During this investigation we will focus on the mechanism used in surrogate motherhood contracts; For this study, we will point out the role of the Peruvian state and the national legal norms that have led to safeguard the integrity of the contracting woman and the contracted person, to understand what is the scenario to establish a model or a hierarchical order on surrogate motherhood contracts and this determine parameters for the protection of the integrity of both the surrogate mother and the contracting party. Understanding this study mechanism, we can point out the following objective research to evaluate and safeguard said right and thus complete the nucleus of the family or society, as established by our Political Constitution, understanding that every human being has the right to reproduction, to have a family, and that this new alternative of assisted pregnancy can make a new generation where parents and families can reach and complete the role of life; With this mechanism, what we are looking for is to establish what is the legal right protected with respect to the family, if the legal right protected by the state can frame a different panorama to safeguard the action before said contract, for which reason in Peru there is no even this mechanism to protect the contracting parties.
