El propósito de este estudio fue examinar la regulación normativa de los derechos sucesorios
del concebido post mortem en el Perú. Se planteó la hipótesis de que la regulación normativa
de los derechos sucesorios del concebido post mortem en el Perú es insuficiente debido a la
ausencia de un estatuto explícito. Dentro del marco teórico se desarrolló y analizó teoría
referida a las categorías de estudio que son, el concebido postmortem y los derechos sucesorios.
La investigación fue cualitativa documental, la discusión de los resultados se realizó a través
de la argumentación jurídica en base a los datos teóricos y fácticos. Las hipótesis fueron
validadas, los objetivos alcanzados y la conclusión principal: En el Perú, no existe regulación
normativa expresa sobre los derechos sucesorios del concebido post mortem procreado bajo
técnicas de reproducción humana asistida, asimismo la recomendación fundamental está
dirigida al Poder Legislativo en el sentido de regular los derechos sucesorios del concebido
post mortem, con la finalidad de tener adecuados parámetros legales que permitan un manejo
óptimo de la filiación y consiguientes derechos sucesorios de los hijos nacido fruto de esta
técnica de reproducción. The purpose of this study was to examine the normative regulation of the inheritance rights of
the conceived post mortem in Peru. It was hypothesized that the normative regulation of the
inheritance rights of the conceived post mortem in Peru is insufficient due to the absence of an
explicit statute. Within the theoretical framework, theory was developed and analyzed in
relation to the categories of study, which are the postmortem conceived person and inheritance
rights. The research was qualitative documentary, the discussion of the results was carried out
through legal argumentation based on the theoretical and factual data. The hypotheses were
validated, the objectives achieved and the main conclusion: The normative regulation of the
inheritance rights of the conceived post mortem in Peru is deficient because there is no express
law, likewise the fundamental recommendation is directed to the Legislative Power in the sense
of regulating the inheritance rights of the conceived post mortem, with the purpose of having
adequate legal parameters that allow an optimal management of the filiation and consequent
inheritance rights of the children born as a result of this reproductive technique.
