El derecho al libre desarrollo de la identidad de género en base a los principios de la igualdad y legalidad con relación a la identificación de las personas transexual y transgénero

Abstract

La investigación desarrollada tiene como título “El derecho al libre desarrollo de la identidad de género en base a los principios de la igualdad y legalidad con relación a la identificación de las personas transexual y transgénero”, dicha investigación tuvo como objetivo general, establecer cuál es el marco normativo que protege el libre desarrollo de la identidad de género en base a los principios de igualdad y legalidad para la identificación de las personas transexual y transgénero. En este sentido se tiene que la investigación es de tipo dogmática, de subtipo propositiva con carácter proyectivo; así mismo es de tipo sociojuridica, de enfoque cualitativo, se utilizo la técnica de análisis documental y entrevista, para lo cual, se utilizaron los instrumentos de recolección de datos como, la ficha de análisis documental y guía de preguntas estructuradas. De igual forma, se planteó como hipótesis general “el inadecuado marco normativo en cuanto al libre desarrollo de la identidad de género, en base a los principios de igualdad y legalidad de las personas transexual y transgénero en el Perú, no protege el ejercicio del libre desarrollo del derecho a la identidad de género”, llegando a confirmar dicha indicación de manera total; dado que existe insuficiente marco legislativo en cuanto al tema de identidad de género.

In this sense, the research is of a dogmatic type, of a propositional subtype with a projective character; Likewise, is of a socio-legal type, with a qualitative approach, the technique of documentary analysis and interview was used, for which data collection instruments such as the Documentary Analysis Sheet and the Guide of Structured Questions were used. In the same way, “the inadequate normative framework regarding the free development of gender identity, based on the principles of equality and legality of transsexual and transgender people in Peru, was raised as a general hypothesis, does not protect the exercise of the free development of gender identity gender right to gender identity”, fully confirming said indication; given that there is not a sufficient legislative framework in relation to the issue of gender identity.
