encuentren vulnerados. In the present thesis, the current impact of deliberative democracy is deepened; in addition,
the rupture between the State and the population on the basis of the right of citizen
participation is evidenced. To this end, the implications of democracy in general are
addressed, which also entails a development of important aspects of democracy, as well as
the repercussions that these ideas have had on the current constitutional development and
the Political Constitution of Peru of 1993. Finally, the research seeks to provide a new
formula for the development of the legislative procedure, based on deliberation, to reduce
the gap between the State and the population in cases where the rights of civil society are
violated.
