Este trabajo de investigación de título “PRETENSIÓN PRINCIPAL DE
INDEMNIZACIÓN POR RESPONSABILIDAD EXTRACONTRACTUAL EN EL
PROCESO CONTENCIOSO ADMINISTRATIVO DERIVADOS DE TÍTULOS DE
PROPIEDAD EXPEDIDOS POR COFOPRI Y LA TUTELA JURISDICCIONAL
EFECTIVA EN EL DISTRITO DE CUSCO 2022” ;TUBO COMO OBJETIVO: Describir
si la pretensión principal de indemnización por responsabilidad extracontractual en el
proceso contencioso administrativo derivados de títulos de propiedad expedidos por
COFOPRI surgidas por regularización de tracto sucesivo y su cuestionamiento, puede ser
una garantía para reconocer y resguardar el derecho a la tutela jurisdiccional efectiva, fue
una; INVESTIGACIÓN tipo, cualitativo y un diseño no experimental, descriptivo, para la
recolección de datos se utilizó el; INSTRUMENTO análisis documental de casaciones y de
encuestas con previo conocimiento de casaciones, su respectiva; POBLACIÓN que estuvo
constituido por 30 personas del Distrito del Cusco y está a su vez subdividido por dos
subpoblaciones; La primera estuvo compuesta por 10 abogados especialistas en derecho
administrativo y civil que vienen realizando defensa en asuntos contenciosos
administrativos. Asimismo como segunda población se tiene a 20 personas entre litigantes,
y personas con previo conocimiento de jurisprudencia entre ellas: Casacion Nro 4627-2017-
Ancash
(Publicado: 01/06/2020) y 2628-2018-Ica
(Publicado 08/08/2019), que trae consigo
cuestionamiento de títulos administrativos: Títulos de COFOPRI por tracto sucesivo en la
vía civil, por personas que a la vez tienen expeditos su derecho de solicitar indemnización
pero se les impide en el proceso contencioso administrativo, de los; RESULTADOS se ha
concluido que: La pretensión principal de indemnización por responsabilidad
extracontractual en el proceso contencioso administrativo derivados de títulos de propiedad
expedidos por COFOPRI provenientes por regularización de tracto sucesivo y su cuestionamiento, es una garantía para reconocer y resguardar el derecho a la tutela
jurisdiccional efectiva en el sub tipo acceso a la jurisdicción debida

proceso en los subtipos: Pro actione, economía procesal. This research work with the title "PRINCIPAL CLAIM OF INDEMNIFICATION
FOR EXTRACTUAL LIABILITY IN THE ADMINISTRATIVE CONTENTION
PROCEDURE DERIVED FROM PROPERTY TITLES ISSUED BY COFOPRI AND THE
EFFECTIVE JURISDICTIONAL TUTELA IN THE DISTRICT OF CUSCO 2022" ;HAD
AS OBJECTIVE: To describe whether the main claim for compensation for tort liability in
the administrative litigation process arising from property titles issued by COFOPRI arising
from regularization of successive tract and its questioning, can be a guarantee to recognize
and safeguard the right to effective judicial protection, was a; RESEARCH type, qualitative
and a non-experimental, descriptive design, for data collection was used the; INSTRUMENT
documentary analysis of cassations and surveys with prior knowledge of cassations, their
respective; POPULATION which was constituted by 30 people of the District of Cusco and
is in turn subdivided by two subpopulations; The first was composed of 10 lawyers
specializing in administrative and civil law who have been performing defense in
administrative contentious matters. Also as a second population we have 20 people between
litigants, and people with prior knowledge of jurisprudence among them: Casacion Nro
4627-2017-Ancash

which brings with it questioning of administrative titles: COFOPRI titles by successive tract
in the civil route, by people who at the same time have expedited their right to request
compensation but are prevented in the administrative contentious process, from the;
RESULTS it has been concluded that: The main claim for compensation for non-contractual
liability in the administrative contentious process derived from property titles issued by
COFOPRI arising from regularization of successive tract and its questioning, is a guarantee
to recognize and safeguard the right to effective jurisdictional protection in the subtype access to due jurisdiction(competence
) and due process in the subtypes: Pro actione,
procedural economy.
