En la presente investigación el objetivo general es “Identificar la afectación del derecho
fundamental a la salud por el hacinamiento en el establecimiento penal de Qquenccoro -
Periodo 2020”, hemos investigado si el derecho a la salud es afectado por el hacinamiento,
más aún en el contexto de la pandemia del COVID-19, en la cual se necesita adoptar medidas
urgentes para garantizar los diferentes derechos, así como asegurar las condiciones dignas
que cada ser humano necesita.
Entre las conclusiones a las que arribamos fueron: Primero: En el centro penitenciario de
Qquenccoro la capacidad para albergar aproximadamente 1,616 internos, sin embargo, a la
fecha alberga aproximadamente 2,988 habitantes internos varones, existiendo una
sobrepoblación y hacinamiento de 1,372 internos (se encuentra en un 184% de ocupación)
existiendo sobrepoblación y hacinamiento. Los funcionarios poco o nada pueden hacer ante
esta difícil realidad, vulnerándose los derechos fundamentales de los internos, como es el
derecho a la salud, educación, otros. Segundo: El hacinamiento en los establecimientos
penales a nivel latinoamericano y nacional, afecta la función de los centros penitenciarios,
provocando la vulneración de diferentes derechos fundamentales. La aplicación de políticas
penitenciarias en el Centro Penitenciario de Qquenccoro en estas condiciones de
hacinamiento resulta prácticamente difícil, reduce la capacidad de atención tanto de las
instalaciones como de los servicios intramuros: salud, seguridad y atención en otros servicios.
Tercero: El hacinamiento penal en el Centro Penitenciario de Qquenccoro afecta el derecho
fundamental a la salud, ya que provoca precarias condiciones de salubridad e higiene, que se
agrava en el contexto actual por el mayor riesgo ante el avance del COVID-19; ya que no se
puede cumplir con los protocolos de bioseguridad, se encuentran diferentes grupos etareos
entre los internos en situación de vulnerabilidad, como personas mayores, diabéticas,
hipertensas, pacientes inmunosuprimidos, pacientes oncológicos, con enfermedades
autoinmunes, con insuficiencia cardíaca e insuficiencia renal crónica, entre otros. Por lo que
el derecho fundamental a la salud es afectado por el hacinamiento en el establecimiento penal
de Qquenccoro periodo 2020. Cuarto: El aumento de la densidad poblacional del
Establecimiento Penal de Qquenccoro ha superado la capacidad de albergue, siendo los
internos con prisión preventiva un total de más del 42% de la población penitenciaria,
evidenciándose que es una de las principales causas del hacinamiento penitenciario que
ocasiona el problema de la infraestructura insuficiente. In this research, the general objective is to “Identify the impact on the fundamental right to
health by overcrowding in the Qquenccoro prison - Period 2020“. We have investigated
whether the right to health is affected by overcrowding, even more so in the context of the
COVID-19 pandemic, in which urgent measures are needed to guarantee the different rights,
as well as to ensure the dignified conditions that each human being needs.
Among the conclusions we reached were: First: In the Qquenccoro penitentiary, the capacity
to house approximately 1,616 inmates, however, to date it houses approximately 2,988 male
inmates, with an overcrowding and overcrowding of 1,372 inmates (it is located in 184%
occupancy) existing overcrowding and overcrowding. Civil servants can do little or nothing
in the face of this difficult reality, violating the fundamental rights of inmates, such as the
right to health, education, and others. Second: Overcrowding in prisons at the Latin American
and national level affects the function of prisons, causing the violation of different
fundamental rights. The application of prison policies in the Qquenccoro Penitentiary Center
in these overcrowded conditions is practically difficult, it reduces the care capacity of both
the facilities and the intramural services: health, security and attention in other services.
Third: The criminal overcrowding in the Qquenccoro Penitentiary Center affects the
fundamental right to health, since it causes precarious health and hygiene conditions, which is
aggravated in the current context due to the greater risk due to the advance of COVID-19;
since it is not possible to comply with biosafety protocols, there are different age groups
among inmates in vulnerable situations, such as elderly, diabetic, hypertensive,
immunosuppressed patients, cancer patients, with autoimmune diseases, with heart failure
and chronic kidney failure , among others. Therefore, the fundamental right to health is
affected by overcrowding in the Qquenccoro prison in the 2020 period. Fourth: The increase
in the population density of the Qquenccoro Penal Establishment has exceeded the shelter
capacity, being inmates with preventive detention a total of more than 42% of the prison
population, evidencing that it is one of the main causes of prison overcrowding that causes
the problem of insufficient infrastructure.
