La presente tesis “El principio de predictibilidad y la calificación registral en la oficina
registral de Cusco” ha tenido como objetivo general averiguar las razones de porque no se
aplica el principio de predictibilidad en la calificación registral la Zona N° X – Sede Cusco de
Registros Públicos y así mismo averiguar porque se permite la doble calificación aun título ya
estudiado previamente. Se demostró que en la realidad actual el administrado usuario de los
servicios de SUNARP en Cusco presenta un malestar cotidiano enmarcado en la inaplicación del
principio de predictibilidad acarreando ello un perjuicio en los usuarios que al presentar un título
con los requisitos solicitados en el reglamento de registros públicos estos muchas veces son
observados para posteriormente ser subsanados en tenor a dicha observación, pero a la hora de
presentar nuevamente la documentación solicitada por el registrador inicial por diversas razones
no le toca al mismo que califico en un inicio y este es derivado a otro registrador que no tiene
conocimiento de lo antecedido y por la facultad de individualismo e independencia que poseen
estos funcionarios vuelven a hacer una nuevo estudio de título aplicando su criterio de
interpretación personal, emitiendo posteriormente su criterio de calificación de manera formal
(anotación de inscripción – observación - tacha) que muchas veces se aleja del que inicialmente
lo reviso siendo totalmente discrepante hasta llegar al punto de rechazar la subsanación e
inclusive generar nuevas observaciones no hechas al principio de la calificación inicial o llegar al
punto de tachar los títulos generando toda esta situación un malestar justificado en los usuarios
manifestando pérdida de tiempo y dinero por no existir un acuerdo interno entro los registrador
para que esto no suceda de manera reiterativa. In this thesis “The principle of predictability and the registry qualification in the registry office of
Cusco“ has had as general objective to find out the reasons why the principle of predictability is
not applied in the registry qualification of Zone N ° X - Cusco Registers Headquarters Public and
also find out why double qualification is allowed on a previously studied degree. It was shown
that in the current reality, the administered user of SUNARP services in Cusco presents a daily
discomfort framed in the non-application of the principle of predictability, thus causing damage
to users who by presenting a title with the requirements requested in the registration regulations

registrar. who has no knowledge of the foregoing and due to the faculty of individualism and
independence that these officials have, they do a new degree study applying their personal
interpretation criteria, subsequently issuing their qualification criteria in a formal way
(registration annotation - observation - cross out) that many times moves away from the q I
initially reviewed it being totally disagreeing until I reached the point of rejecting the correction
and even generating new observations not made at the beginning of the initial qualification or
reaching the point of crossing out the titles, generating all this situation a justified discomfort in
the users manifesting loss of time and money for not having an internal agreement between the
registrars so that this does not happen repeatedly.
