El ejercicio del derecho de sufragio de los internos procesados con prisión preventiva en el Establecimiento Penitenciario de Sicuani de la provincia de Canchis, región Cusco

Nuestro país no es ajeno al tema que se trató en la presente investigación, hablar sobre
derecho al sufragio es referirnos a uno de los tantos derechos que todo ciudadano libre de
impedimento tiene dentro de una sociedad, hablar de los procesados quienes se encuentran
con prisión preventiva a la espera de una sentencia nosotros consideramos que son
ciudadanos también, pero con un impedimento sobre su libertad ambulatoria por causa de un
proceso, es así que la presenta investigación consta de IV Capítulos y se desarrolló de la
siguiente manera:
En el primer capítulo se aborda el problema de investigación, y detallar los objetivos las
razones en las que justifica, y la delimitación. En el segundo capítulo se desarrolla el marco
teórico, los antecedentes de la investigación, dentro de las bases teóricas se pudo realizar
aspectos sobre la participación ciudadana, suspensión o perdida de la ciudadanía, derecho al
sufragio, restricciones, la negación del derecho al sufragio, el voto, perdida de la libertad,
prisión preventiva, fines de la prisión preventiva. Los criterios utilizados para imponerla
prisión preventiva, en el capítulo tercero se estable la metodología sobre la que se desarrolló
la presente investigación y por último dentro del cuarto se determinaron los resultados y las
fuentes de información a través del cual se pudo llevar adelante la presente investigación.
En la Provincia de Canchis así como en los distintos penales a nivel nacional existe un sector
de ciudadanos que se encuentran internados en los diferentes establecimientos penitenciarios,
los mismos que se hallan recluidos a la espera de una sentencia, en algunos según a las
circunstancias, el ministerio publico solicitara su prorroga al término de esta, así como
también seguramente muchos de los internos no llegan a ser sentenciados es esa la situación de muchos internos, es decir no pueden sufragar ya que mientras no haya sentencia firme
todo ciudadano es considerado como inocente y por lo tanto sus derechos se encuentran
intactos, pero sucede que en muchos países europeos, latinoamericanos los internos sin
sentencia pueden sufragar como el caso de Colombia o Argentina entre otros.
Y estamos seguros que este derecho en algún momento de la historia será objetiva, siempre
en cuando no existan intereses sociopolíticos, según a las opiniones de los expertos la única
manera de que este derecho al sufragio se haga positivo es una decisión política firme como
una manera de inclusión de los internos con medida cautelar, nuestra constitución, así como
las normas internacionales regulan el derecho y el deber de elegir y ser elegidos.
Nosotros consideramos que es un avance que en los últimos tiempos se esté dando de alguna
manera iniciativa respecto a esta materia un claro ejemplo es la iniciativa planteada por el
jurado nacional de elecciones donde se plasma el derecho al sufragio de los internos con
prisión preventiva, pero como dijimos líneas arriba son cuestiones de política donde la
indiferencia del congreso para tratar temas que consagran derechos se hacen menos efectivas,
razón por la cual este derecho se encuentra postergado.
Lo cierto es que actualmente los procesados con prisión preventiva no sufragan en los
comicios electores a pesar de que siguen teniendo la condición de ciudadanos a los que no
les restringe legalmente tal derecho, la constitución establece cuando se pierde la ciudadanía,
así como también la norma constitucional establece que es nulo y punible todo acto que
prohíba o limite al ciudadano el ejercicio de sus derechos. Por lo que nosotros consideramos que la prisión preventiva debe tener cierto límite por lo
que no puede restringir derechos como el sufragio, el estado debe implementar los medios
para que se haga efectivo este derecho y así poder hacer partícipe a los aun ciudadano con
prisión preventiva en la vida democrática del país. Our country is not alien to the subject that was discussed in the present investigation, to speak

their ambulatory freedom because of a process, this is how the present investigation consists
of V Chapters and was developed in the following way:

was possible to realize aspects on the citizen participation, suspension or loss of the
citizenship, right to the suffrage, restrictions, the negation of the right to the suffrage, the
vote, loss of liberty, preventive detention, pretrial detention. The criteria used to impose
preventive detention. Finally, in the third chapter, the methodology on which the present
investigation was developed was established and finally, within the fourth and fifth chapters,
the results and sources of information through which the present investigation was carried
out were determined.
In the Province of Canchis as well as in the different prisons at the national level there is a
sector of citizens who are interned in the different penitentiary establishments, the same who
are being held awaiting a sentence, in some according to the circumstances the ministry
public request its extension at the end of this, as well as surely many of the inmates do not
get sentenced is that the situation of many inmates, that is, they can not pay because as long as there is no final judgment every citizen is considered innocent and therefore their rights
are intact, and that is why in many European countries, Latin Americans inmates without
sentence can pay as in the case of Colombia or Argentina among others.
And we are sure that this right at some point in history will be objective, as long as there are
no sociopolitical interests, according to the experts' opinions the only way that this right to
vote becomes positive is a firm political decision as a way of inclusion of inmates with
precautionary measure, our constitution, as well as international standards regulate the right
and duty to elect and be elected.
We consider that it is an advance that in recent times is taking some initiative in this matter
a clear example is the initiative put forward by the national election jury where the right to
suffrage of inmates with preventive detention, but As we said above, these are questions of
policy where the indifference of the congress to deal with issues that consecrate rights
become less effective, which is why this right is postponed.
The truth is that currently the defendants with preventive detention do not pay in the elective
elections although they still have the status of citizens who are not legally restricted by that
right, the constitution establishes when citizenship is lost, as well as the norm The
Constitution establishes that any act that prohibits or limits the citizen's exercise of their
rights is null and punishable.
For what we consider that preventive detention must have a certain limit so it can not restrict
rights such as suffrage, the state must implement the means for this right to be enforced and thus be able to involve even a citizen in preventive detention in the democratic life of the
country.
