RESÚMEN 
  En la presente investigación, al advertir que las medidas cautelares de 
suspensión de actividades en locales no exclusivos  adoptadas por el 
Organismo Supervisor de la Inversión en Energía y Minería - OSINERGMIN, 
como consecuencia de la venta informal de Combustible Líquido y/o Gas 
Licuado de Petróleo, no resulta eficaz, pues en base a una reflexión teórica 
apoyada en la idea de la tutela inhibitoria y la necesidad de proteger la 
Seguridad Pública, se propone el obligatorio y efectivo cumplimiento del comiso 
de bienes como medida cautelar, lo cual permitirá que las actividades 
desarrolladas al margen de la Ley disminuyan, además se potencializará la 
tutela de la seguridad pública, que involucra Derechos individuales como el 
derecho a la VIDA y la  SALUD.

ABSTRACT 
 In our investigation, noting that the precautionary measures to suspend 
activities in non-exclusive premises adopted by the Supervisory Agency for 
Energy and Mining Investment - OSINERGMIN, as a result of the informal sale 
of Liquid Fuel and / or Liquefied Petroleum Gas, Is not effective, because based 
on a theoretical reflection based on the idea of inhibitory protection and the 
need to protect Public Security, it is proposed the mandatory and effective 
enforcement of the property commission as a precautionary measure, which will 
allow the activities developed In addition to the Law decrease, in addition will 
enhance the protection of public safety, which involves individual rights such as 
the right to LIFE and HEALTH.
