RESUMEN 
 
La presente investigación, está contenida en la vulneración de derechos 
laborales, producidas por la pandemia de la Covid-19, que afecto numerosos derechos 
laborales tanto en el derecho laboral privado, a esos trabajadores independientes e 
informales que fueron obligados a cerrar sus puestos donde laboraban sean en las 
arterias de la ciudad o centros comerciales, caso de los mercados de abastos, 
transportistas, guías turísticos, restaurantes, por ejemplo y a los del derecho laboral 
público, a quienes se les disminuyo del salario, así como el incumplimiento de los 
pactos colectivos, ampliación de los horarios de trabajo con la implementación del 
teletrabajo o trabajo a distancia, obligación al trabajo presencial pese al masivo 
contagio del coronavirus en muchos centros laborales. 
           Es por ello, que buscaremos esclarecer cuales fueron aquellos derechos 
vulnerados durante el Estado de Emergencia, y sus posibles soluciones, frente a 
futuros Estados de Emergencia.

ABSTRAC 
 
 
 The present investigation is contained in the violation of labor rights, produced 
by the Covid-19 pandemic, which affected numerous labor rights both in private labor 
law, to those independent and informal workers who were forced to close their 
positions where they worked. whether in the arteries of the city or shopping centers, in 
the case of food markets, carriers, tour guides, restaurants, for example, and those of 
public labor law, whose salary was reduced, as well as non-compliance with collective 
agreements , extension of work hours with the implementation of teleworking or remote 
work, obligation to face-to-face work despite the massive contagion of the coronavirus 
in many workplaces. 
 
 For this reason, we will seek to clarify which rights were violated during the 
State of Emergency, and their possible solutions, in the face of future States of 
Emergency.
