RESUMEN 
La presente investigación titulada “La vulneración de los derechos laborales y el 
mecanismo de la suspensión perfecta en el régimen de la actividad laboral privada”, lleva 
a cabo un análisis interpretativo referido al mecanismo de la suspensión perfecta en el 
régimen laboral privado, en el contexto de la emergencia sanitaria; es por ello que surge 
el problema general ¿El mecanismo de la suspensión perfecta en el régimen laboral 
privado, provoca la vulneración del derecho fundamental a la libertad de trabajo? siendo 
el objetivo general de la investigación, analizar si el mecanismo de la suspensión perfecta 
en el régimen laboral privado provoca la vulneración del derecho fundamental a la 
libertad de trabajo, es así que se propuso como  hipótesis general que el mecanismo de la 
suspensión perfecta en el régimen laboral privado, provoca, la vulneración del derecho 
fundamental a la libertad de trabajo. 
 Es por ello que logramos determinar que la problemática se genera a raíz de una 
vulneración gradual al derecho fundamental de la libertad de trabajo, así como la 
inequívoca regulación de lo que vendría a ser la aplicación de la herramienta de la 
suspensión perfecta de labores en el sector privado. 
Frente a lo señalado anteriormente, la recomendación planteada es que, ante una probable 
aplicación del mecanismo de la suspensión perfecta frente a una situación de emergencia, 
se sugiere una mejor regulación de este mecanismo, partiendo desde la aprobación de la 
figura del silencio positivo administrativo por parte de la entidad competente.

ABSTRACT 
The present research paper titled "The violation of labor rights and the mechanism of 
perfect suspension law in the regime of private labor activity", has the purpose of doing 
an interpretive analysis referring to the mechanism of perfect suspension act in the private 
labor regime, in the context of the health emergency; That is why the following 
 General problem arises: Does the mechanism of perfect suspension law in the private 
labor regime cause the violation of the fundamental right to freedom of work? being the 
general objective of the investigation, to analyze if the mechanism of the perfect 
suspension law in the private labor regime causes the violation of the fundamental right 
to freedom of work, Therefore, it was proposed as a general hypothesis that the 
mechanism of perfect suspension law in the private labor regime causes the violation of 
the fundamental right to freedom of work. 
That is the reason it was possible to determine that the problem is generated as a result of 
a gradual violation of the fundamental right of freedom of work, as well as the 
unequivocal regulation of what would become the application of the tool of the perfect 
suspension of work law in the private sector. 
Because of the above, the recommendation is that, in the face of a probable application 
of the mechanism of perfect suspension law in an emergency, better regulation of this 
mechanism is suggested, starting from the approval of the figure of positive 
administrative silence by part of the competent entity.
