RESUMEN 
En el presente trabajo de investigación busca fundamentar la problemática de la determinación 
del quantum indemnizatorio en el delito de tráfico ilícito de insumos químicos y maquinarias 
destinados a la minería ilegal, siendo un problema de índole social y jurídico, afectando el bien 
jurídico del delito en mención, ya que aún no existe una valoración clara y motivada del daño 
ambiental, en cuanto a la reparación indemnizatorio de aquellos que ocasionan el delito de 
tráfico ilícito de insumos químicos y maquinarias destinados a la minería ilegal en el distrito de 
Inambari  
     En el Capítulo I de nuestra tesis nos refiere el problema y los aspectos metodológicos del 
estudio que se aborda en el trabajo.  
     En el Capítulo II, abordamos los antecedentes de nuestra tesis, anteriores investigaciones por 
otros autores. 
     En el Capítulo III, IV, V,VI, VII comenzaremos a profundizar los temas preliminares que son 
fundamentales en estudiar para ir entendiendo el problema en sí; siendo estos capítulos; sobre el 
daño ambiental, la reparación civil ambiental, conceptos básicos del delito de Minería ilegal y 
delito de tráfico ilícito de insumos químicos destinados a la minería ilegal, el modus operandi 
que se aprecia, a través de las resoluciones de las sentencias emitidas por el cuarto juzgado de 
investigación preparatoria en delitos ambientales de Tambopata, donde profundizaremos más 
sobre nuestro problema en cuanto a la determinación del quantum indemnizatorio del Delito de 
tráfico Ilícito de Insumos químicos destinados al a minería ilegal en el distrito de Inambari

ABSTRACT 
In the present research work seeks to substantiate the problem of determining the amount of 
compensation in the crime of illicit trafficking of chemical inputs and machinery intended for 
illegal mining, being a problem of social and legal nature, affecting the legal right of the crime in 
question , since there is still no clear and motivated assessment of environmental damage, as 
regards compensatory reparation for those that cause the crime of illicit trafficking of chemical 
inputs and machinery destined for illegal mining in the district of Inambari 
     In Chapter I of our thesis, he refers us to the problem and the methodological aspects of the 
study that is approached in the work. 
     In Chapter II, we address the background of our thesis, previous research by other authors. 
     In Chapter III, IV, V, VI, VII we will begin to deepen the preliminary issues that are 
fundamental in studying to understand the problem itself; being these chapters; on environmental 
damage, civil environmental compensation, basic concepts of the crime of illegal mining and 
crime of illicit trafficking of chemical inputs for illegal mining, the modus operandi that is 
appreciated, through the resolutions of the sentences issued by the fourth court of preparatory 
investigation in environmental crimes of Tambopata, where we will deepen more about our 
problem regarding the determination of the compensation quantum of the Illicit Trafficking 
Crime of chemical Inputs destined to illegal mining in the district of Inambari
