RESUMEN 
En el presente Informe Académico realizare la investigación y análisis de un 
expediente Judicial en materia Civil sobre Rescisión de Contrato (Art. 1370 del Código 
Civil), primeramente se realizó un resumen de todo el proceso contenido en un expediente 
con 560 folios, posteriormente un análisis del proceso donde se verifica los errores o 
aciertos que se cometieron dentro del proceso y como tercer punto se realizó el Marco 
Teórico donde se desarrolló las instituciones jurídicas importantes dentro de este proceso, 
así mismo se presenta Jurisprudencia relacionada con la materia del proceso y finalmente 
se señala las conclusiones a las que arribe después del desarrollo del presente informe.

ABSTRACT 
In this Academic Report, I will carry out the investigation and analysis of a Judicial 
file in Civil Matters on Contract Termination (Art. 1370 of the Civil Code). First, a 
summary of the entire process contained in a file with 560 pages was made, then an 
analysis of the process where the errors or successes that were committed within the 
process are verified and as a third point the Theoretical Framework was carried out where 
the important legal institutions were developed within this process, likewise 
Jurisprudence related to the matter of the process is presented and finally notes the 
conclusions reached after the development of this report.

RESUMEN 
En el presente Informe Académico se realizará el respectivo análisis de un expediente 
Judicial en materia penal sobre “Delito de Resistencia o desobediencia a la autoridad, en 
su modalidad de Posesión indebida de teléfonos celulares, o, armas, municiones o 
materiales explosivos, inflamables, asfixiantes o tóxicos en establecimiento 
penitenciario” (Art. 368 - D); el presente informe tiene la finalidad de poner en práctica 
conocimientos y habilidades adquiridos durante mi Formación Profesional. 
Primeramente, se realizará un Resumen del expediente Judicial que consta de 309 fs. 
(Cuadernos Incidentales del Expediente Judicial y Cuadernos de Debate), posteriormente 
un Análisis del Proceso para observar los errores o aciertos realizados dentro del proceso, 
como tercer punto se desplegara el Marco Teórico donde se desarrollara algunas 
Instituciones Jurídicas inmersas en el desarrollo del proceso, consiguientemente se 
invocara Jurisprudencia y finalmente las Conclusiones a las que se arribó después del 
Análisis del presente caso.

ABSTRACT 
In this Academic Report, the respective analysis of a judicial file in criminal matters on the “Crime 
of Resistance or disobedience to the authority, in the form of Improper Possession of cell phones, 
or weapons, ammunition or explosive, flammable, suffocating or toxic in prison establishment” 
(Art. 368 - D); The purpose of this report is to put into practice the knowledge and skills acquired 
during my Professional Training. Firstly, a summary of the judicial file will be made, consisting 
of 309 pages. (Incidental Notebooks of the Judicial File and Discussion Notebooks), later an 
Analysis of the Process to observe the errors or successes made within the process, as a third point 
the Theoretical Framework will be displayed where some Legal Institutions immersed in the 
development of the process will be developed, consequently Jurisprudence was invoked and 
finally the Conclusions reached after the Analysis of the present case.
