RESUMEN 
 
El presente trabajo de investigación, lleva como título “La problemática registral derivada del 
proceso de formalización de predios rurales en el distrito de Lamay, provincia de Calca”, y 
tiene como objetivo general identificar la problemática registral derivada del proceso de 
formalización de predios rurales por prescripción adquisitiva administrativa en el distrito de 
Lamay, provincia de Calca.  
Que como objetivos específicos se ha planteado disminuir los problemas derivados de la 
formalización de predios rurales y si es viable legalmente la unificación de catastros de 
Registros Públicos y DIRAGRI en los procesos de formalización de pedios rurales. 
En esa perspectiva se ha determinado que la problemática registral se da por las 
superposiciones  que  se presentan  entre predios  rurales  y que la titulación masiva  es una de 
las principales soluciones a la problemática registral  y que la unificación de registros no es 
factible  legalmente en razón de que el catastro de DIRAGRI  es  técnico(se trabaja en base a 
una base grafica)   y el catastro de Registros públicos es jurídico y busca la seguridad jurídica, 
publicidad y erga omnes(oponer derechos frente a terceros). 
Las soluciones plateadas en el presente caso como la titulación masiva contribuirán  a superar 
los problemas de  superposición de  predios rurales en el distrito de Lamay y ello influirá 
directamente en su calidad de vida  de los pobladores del distrito de Lamay, pues  estas personas 
serán sujetos de crédito.

ABSTRACT 
This research work is entitled “The registration problem derived from the process of 
formalization of rural properties in the district of Lamay, province of Calca”, and its general 
objective is to identify the registration problem derived from the process of formalization of 
rural properties by administrative purchasing prescription in the district of Lamay, province of 
Calca. 
That as specific objectives it has been proposed to reduce the problems derived from the 
formalization of rural properties and if the unification of cadastre of Public Registries and 
DIRAGRI in the formalization processes of rural pedios is legally viable. 
In this perspective, it has been determined that the registration problem is due to the overlaps 
that occur between rural properties and that massive titling is one of the main solutions to the 
registration problem and that the unification of records is not legally feasible because The 
DIRAGRI cadastre is technical (it works based on a graphic base) and the Public Registries 
cadastre is legal and seeks legal security, publicity and erga omnes (opposing rights against 
third parties). 
The silver solutions in the present case such as the massive titling will contribute to overcoming 
the problems of overlapping rural properties in the district of Lamay and this will directly 
influence their quality of life of the residents of the district of Lamay, as these people will be 
subject to credit.
