RESUMEN 
La presente investigación, tuvo como objetivo determinar en qué medida la aplicación de 
los regímenes penitenciarios afectan el principio de interés superior del niño, y dentro de ello 
la identificación de los principios constitucionales que se optimizan en cada una de las 
instituciones o categoría en la aplicación de ambas. Para ello se planteó una metodología de 
carácter mixto que se apoyó en el estudio de una serie de documentos, así como el análisis 
de una serie de encuestas realizadas a un grupo de profesionales ligados a la actividad. De 
esta manera se contrasto la relación propuesta de las dos categorías, teniendo como resultado 
la confirmación de la hipótesis de trabajo, arribando a una serie de conclusiones que 
establecen que efectivamente la aplicación de los regímenes penitenciarios afecta en alguna 
medida el principio de interés superior del niño.

ABSTRACT 
The present investigation, aimed to determine to what extent the application of prison 
regimes affect the principle of the best interests of the child, and within this the identification 
of the constitutional principles that they are optimized in each of the institutions or category 
in the application of both. To this end, a mixed methodology was proposed, based on the 
study of a series of documents, as well as the analysis of a series of surveys carried out with
