RESUMEN 
     
El presente trabajo de investigación realiza el análisis sobre la situación de los 
homosexuales frente a las actitudes discriminatorias por parte de los heterosexuales en la ciudad 
de Cusco, cuyo objetivo es poder demostrar si efectivamente esta comunidad se encuentra en 
un estado de indefensión en nuestra ciudad y las consecuencias que traen consigo, en caso 
hubiere la discriminación, de igual manera se hace el análisis relacionado a nuestra normativa 
y cómo esta ayuda o no a los derechos fundamentales de los homosexuales. Al ser un tema muy 
controversial y que viene tomando fuerza desde hace algunos años atrás necesita ser estudiado 
y analizado desde el punto del Derecho con el fin de que este garantice sus derechos a la 
igualdad y no discriminación. Un grupo de homosexuales que estudian en la Universidad 
Nacional de San Antonio Abad del Cusco y en la Universidad Andina del Cusco han 
presenciado o han sido vulnerados en su integridad, no solo física, sino también psicológica, 
dando a entender que la sociedad cusqueña, por ser tradicionalista, ejerce actos de violencia y 
discriminación frente a esta minoría.

ABSTRACT 
The present research work analyzes the situation of homosexuals in the face of 
discriminatory attitudes on the part of heterosexuals in the city of Cusco, whose objective is to 
demonstrate if this community is in a state of defenselessness in our city and the consequences 
that come with it, in case there is discrimination, in the same way the analysis is done related 
to our regulations and how this helps or not the fundamental rights of homosexuals. Being a 
very controversial issue and that has been gaining strength for some years now, it needs to be 
studied and analyzed from the point of Law in order that it guarantees its rights to equality and 
non-discrimination. A group of homosexuals who study at the National University of San 
Antonio Abad of Cusco and the Andean University of Cusco have witnessed or have been 
violated in their integrity, not only physical, but also psychological, suggesting that the Cusco 
society, for be a traditionalist, practice acts of violence and discrimination against this minority.
