RESUMEN 
 
El presente caso tiene como antecedentes la demanda postulada con la pretensión de Nulidad 
de Cosa Juzgada Fraudulenta, la misma que tiene como pretensión principal dejar sin efecto 
una sentencia en primera instancia, así como la sentencia de vista que confirmaría la sentencia 
anterior, por lo cual el demandante presente medio probatorios que puedan ser pertinentes y 
útiles para la admisión de la presente demanda, a lo largo del proceso se evalúan todos los 
actos procesales y que estos contengan los requisitos esenciales para ser admitidos. Así se 
tiene que en todo el transcurso del proceso se advierte que el demandado no presenta medios 
probatorios que puedan acreditar el fraude o colusión dentro de la sentencia emitida y a la 
cual se quiere dejar sin efecto, por lo que el juez civil declara improcedente la presente 
demanda, y la sala superior resuelve confirmando dicha sentencia.

ABSTRACT 
 
This case has antecedent the claim postulated with the claim of nullity of Fraudulent Court 
Case, the same as the main claim to leave without effect a judgment in the first instance, as 
well as the hearing ruling that would confirm the previous sentence, for which the plaintiff 
present evidence that may be relevant and useful for the admission of the present lawsuit, 
throughout the process all the procedural acts are evaluated and that these contain the 
essential requirements to be admitted. Thus, throughout the course of the proceedings, it is 
noted that the defendant does not present evidentiary means that can prove fraud or collusion 
within the sentence issued and to which it is intended to be rendered ineffective, for which 
reason the civil judge declares this demand, and the superior room resolves confirming said 
sentence.

RESUMEN: 
 
En este informe académico se analizara el trámite de un Proceso Laboral en la vía 
Ordinaria, que tiene como materia Reconocimiento de Derechos Laborales en donde se   
aborda el caso de la  trabajadora que laboro en la MUNICIPALIDAD PROVINCIAL 
DEL CUSCO como trabajador sujeto a contratación modal. 
Es así que en el proceso se puede apreciar la vulneración a la ley laboral, ya que de los 
hechos se puede apreciar la conducta del empleador al tratar de simular una actividad 
permanente  por uno de naturaleza temporal , es más aduciendo la existencia de un 
régimen especial que no le pertenece a la municipalidad. 
Es así que el órgano jurisdiccional emite la sentencia declarando FUNDADA su 
pretensión  principal e  INFUNDADA su pretensión accesoria de otorgamiento de boletas 
de pago de remuneraciones monto de las remuneraciones peticionadas además ordena que 
la entidad demandada emita una resolución en la que se declare como obrero permanente. 
Decisión que es confirmada por el colegiado superior.

ABSTRACT: 
 
In this academic report we will analyze the processing of a Labor Process in the Ordinary 
way, which has as a subject Labor Rights Recognition where the case of the worker who 
worked in the CUSCO PROVINCIAL MUNICIPALITY as a worker subject to modal 
contracting is addressed. 
Thus, in the process you can see the violation of labor law, since the facts can be seen the 
behavior of the employer to try to simulate a permanent activity by a temporary nature, 
is more by arguing the existence of a special regime that does not belong to the 
municipality. 
Thus, the court issues the ruling declaring FUNDADA its main claim and INFUNDADA 
its accessory claim of granting payment forms of remunerations amount of the 
remunerations requested also orders that the defendant entity issue a resolution in which 
it is declared as a permanent worker. Decision that is confirmed by the superior referee.
