2.- ABSTRACT. 
El presente análisis académico está inmerso en una demanda de División y Partición, figura 
jurídica que ha sido peticionada por la Asociación demandante debidamente representado 
por su presidente, la misma que ha sido dirigida en contra de una pluralidad de sujetos 
demandados, tiene como fundamento jurídico los artículos 983 y 984 del Código Civil, se 
ha declara Improcedente en primera instancia y ha sido confirmada por la Sala Civil de 
Cusco bajo la prerrogativa de que no se acreditado el derecho de propiedad de cada 
copropietario y que adicionalmente no se ha demandado a todos los copropietarios.  
 
This academic analysis is immersed in a demand for Division and Partition, legal figure 
that has been requested by the Housing Association duly represented by its president, which 
has been directed against a plurality of defendants , has as a legal basis articles 983 and 984 
of the Civil Code, has been declared unfounded in the first instance and has been confirmed 
by the Civil Chamber of Cusco under the prerogative that the right of ownership of each co-

2.- ABSTRACT. 
 
This academic analysis is immersed in a demand for Recognition of Contract Indeterminate 
Term, covers the claimant's claim in articles 22, 26 and 27 of the Political Constitution of 
Peru, also in Article 4 of Legislative Decree No. 728, It has declared the claim founded in 
the first instance and has been confirmed by the Constitutional and Social Permanent 
Chamber of the Superior Court of Justice of Cusco, under the foundation that has been 
proved the presumption of the elements that should be included in the term work contracts 
indeterminate, finally the extraordinary appeal has been declared inadmissible. 
 
El presente análisis académico está inmerso en una demanda de Reconocimiento de 
Contrato a Plazo Indeterminado, los demandantes amparan su pretensión en los artículos 
22, 26 y 27 de la Constitución Política del Perú, así como en el artículo 4 del Decreto 
Legislativo N° 728, se ha declarado Fundada la demanda en primera instancia y ha sido 
confirmada en por la Sala Constitucional y Social Permanente de la Corte Superior de 
Justicia de Cusco, bajo el fundamento que se ha acreditado la presunción de los elementos 
que debe contener los Contratos de Trabajo a Plazo Indeterminado, por último se ha 
declarado improcedente el recurso extraordinario de casación.
