RESUMEN 
 
Tanto en el Mundo como en el Perú, tenemos un problema muy grande, y es que la 
violencia en contra de las mujeres viene aumentando, cifras alarmantes que nos señalan 
un problema frecuente en la sociedad que no para y se manifiesta de manera continua, 
mujeres que son maltratadas tanto física como psicológicamente por sus parejas, esposos 
o convivientes que integran el grupo familiar, victimas que en muchas ocasiones viven 
este problema en silencio, sin denunciar, sin realizar ningún acto de protección, y que trae 
como consecuencias muchas veces la muerte de la víctima y el daño psicológico que 
produce a sus hijos, que a futuro se convierte en un círculo vicioso de violencia, por las 
secuelas que produce. 
Cusco es uno de los lugares que presenta mayores índices de violencia, y así mismo el 
Distrito de Oropesa no es ajeno a este problema. 
En el Capítulo I identificaremos el problema de esta investigación, el cual viene a ser las 
consecuencias de la incorporación del Articulo 122-B, el hecho de penalizar las lesiones 
en contra de los integrantes del grupo familiar, fijamos nuestros objetivos, el cual es 
identificar si esta incorporación y modificación del Artículo trae consecuencias positivas 
o negativas, realizamos la Justificación del trabajo y así mismo planteaos nuestra 
hipótesis. 
En el Capítulo II realizaremos el desarrollo de conceptos y teorías que hablan sobre la 
violencia familiar, realzaremos un análisis del Articulo 122-B respecto a tres puntos 
específicos, y analizaremos la Ley 30364, y si esta incorporación y modificación del 
Artículo y la Ley surten efectos o consecuencias, enfocaremos este trabajo en victimas 
por violencia familiar del Detrito de Oropesa, este análisis se realizara respecto a la parte 
de la sanción y a la labor de la Fiscalía Provincial Penal de Quispicanchi.

El Capítulo III está referida al resultado de todo lo hallado en la investigación, a las 
conclusiones a la que llegamos a través de esta investigación, así mismo realizamos 
recomendaciones que pueden ser aplicadas para un mejor funcionamiento.

ABSTRACT 
Both in the World and in Peru, we have a very big problem, which is that violence against 
women is increasing, alarming figures that point to a frequent problem in society that 
does not stop and manifests itself continuously, women who are physically and 
psychologically abused by their partners, spouses or cohabitants who make up the family 
group, victims who often live this problem in silence, without denouncing, without 
performing any act of protection, and which often results in death of the victim and the 
psychological damage that he produces to his children, which in the future becomes a 
vicious circle of violence, due to the consequences it produces. 
Cusco is one of the places that presents higher rates of violence, and likewise that the 
District of Oropesa is no stranger to this problem. 
In Chapter I we will identify the problem of this investigation, which is the consequences 
of the incorporation of Article 122-B, the fact of penalizing the injuries against the 
members of the family group, we set our objectives, which is to identify If this 
incorporation and modification of the Article brings positive or negative consequences, 
we carry out the Justification of the work and likewise propose our hypothesis. 
In Chapter II we will carry out the development of concepts and theories that speak about 
family violence, we will highlight an analysis of Article 122-B regarding three specific 
points, and we will analyze Law 30364, and if this incorporation and modification of the 
Article and the Law favorable effects, we will focus this work on victims of family 
violence of the Detrito de Oropesa, this analysis will be carried out regarding the part of 
the sanction and the work of the Provincial Criminal Prosecutor's Office of Quispicanchi.
