Resumen 
La presente investigación realiza un estudio sobre el delito de tráfico de fauna 
silvestre, que  es uno de los delitos ambientales con mayor incidencia en el país, en 
la actualidad los  ciudadanos aún no tienen conciencia del aprovechamiento 
sostenible de los recursos naturales, referida especialmente en la Ley N°29763, 
para ello se planteó la siguiente investigación “MEDIDAS DE CONTROL SOBRE 
EL TRÁFICO ILEGAL DE FAUNA SILVESTRE; NECESIDAD DE UNA 
ADECUADA APLICACIÓN DE LA LEY ESPECIAL EN EL 
DEPARTAMENTO DE MADRE DE DIOS PERIODO 2016-2017”, donde se 
realizara el análisis de las medidas de control, sobre el tráfico ilegal de fauna 
silvestre en el Departamento de Madre de Dios periodo 2016-2017. Cuyo objetivo 
general fue determinar si las medidas de control, previstas en la ley N°29763, sobre 
el tráfico ilegal de fauna silvestre en el Departamento de Madre de Dios periodo 
2016-2017 son adecuadas para la protección de los recursos naturales. Como 
hipótesis  general se consideró que las medidas de control, previstas en la ley 
N°29763, sobre el tráfico ilegal de fauna silvestre en el Departamento de Madre de 
Dios, periodo 2016-2017 no son adecuadas para la protección de los recursos 
naturales. El tipo de investigación fue Socio-Ambiental-Jurídica, con un enfoque 
cualitativo.

Abstract 
The present investigation carries out a study on the crime of trafficking of wild 
fauna, which is one of the environmental crimes with greater incidence in the country, at 
present the citizens still do not have awareness of the sustainable use of natural resources, 
referred especially in the Law No. 29763, for which the following investigation was 
proposed: "CONTROL MEASURES ON THE ILLEGAL TRAFFIC OF WILD FAUNA; 
NEED FOR ADEQUATE APPLICATION OF THE SPECIAL LAW IN THE 
DEPARTMENT OF MOTHER OF GOD PERIOD 2016-2017, "where the analysis of 
control measures on illegal wildlife trafficking in the Department of Madre de Dios period 
2016- 2017 Whose general objective was to determine if the control measures, provided in 
Law No. 29763, on illegal wildlife trafficking in the Department of Madre de Dios period 
2016-2017 are adequate for the protection of natural resources. As a general hypothesis, it 
was considered that the control measures, foreseen in Law No. 29763, on illegal wildlife 
trafficking in the Department of Madre de Dios, 2016-2017 period are not adequate for the 
protection of natural resources. The type of research was Socio-Environmental-Legal, with
