RESUMEN. 
 
La presente investigación, tiene como objetivo, identificar las razones 
jurídicas del por qué, no se indemnizan a los familiares de las víctimas que 
perdieron la vida humana durante una protesta social; así como, identificar los 
tipos legales que se comenten con la materialización de las protestas 
sociales, finalmente, identificaremos los derechos fundamentales que 
colisionan con la realización de las protestas sociales. 
 
La presente investigaciones es de carácter dogmática propositiva, con un 
enfoque cualitativo, los métodos para  la recolección de los datos, es el 
analítico. 
 
Luego de realizar los estudios, llegamos a entender que, la falta de 
indemnización en favor de los familiares de las victimas caídas en protestas 
sociales, se debe a la falta de una regulación jurídica al respecto, asimismo 
sostenemos que, durante el desarrollo de las protestas sociales, se incurren 
en la comisión de tipos legales, tales como, delitos contra los medios de 
comunicación, contra la propiedad privada y otros tipos legales con las que se 
les inicia los procesos penales, por tal razón recomendamos, que se tenga que 
legislar las protestas sociales en el Perú. 
 
 
 
 
 
 
 
ABSTRACT. 
 
This research aims to identify the legal reasons why not to the families of 
the victims who lost human life for a social protest are compensated; and 
identify the statutory rates that are committed to the realization of social 
protests eventually identify the fundamental rights collide with the realization of 
social protests. 
 
This research is purposeful dogmatic character, with a qualitative 
approach, methods for data collection, is analytical. 
 
After conducting studies, we come to understand that the lack of compensation 
for the families of the victims falls in social protests is due to the lack of legal 
regulation in this regard, also argue that, in the course of the protests social, 
incurred in the commission of legal, such as crimes against the media, against 
private property and other legal types with which they initiated criminal 
proceedings for this reason we recommend types, which require enacting the 
social protests in Peru.
